    published {morning} a draft text of the First Amendment to the Law of the House of Representatives elections and following the text of the bill: on
    behalf of the people of the
    Presidency of the Republic
    based on what was approved by the House of Representatives and approved by the President of the Republic , based on the provisions of item (i) of Article (61) and item ( Third) of Article (73) of the Constitution , issued the following law:
    No. () of the 2017 Act of the first amendment to the law of the House of Representatives elections No. (45) for the year 2013 Article 1 - The text of Article (1) of the law and replaced by the following: Article 1 - the following terms are intended for the purposes of this law , the meanings set forth towards them: the Council: the Iraqi Council of Representatives Commission: Commission Ala Leah independent elections. Voter: Iraq in which the legal and civil conditions for voting in the elections is available. Diaspora voters: An Iraqi who has been forcibly deported from the place of permanent residence outside his province 9/4/2003 for any reason whatsoever. Record primary voters: the record that contains the names and data of voters, which is prepared and published by the Commission for it and appeals on it. The final record of voters: record the names of voters and the data is subject to appeal, which is published after the end of the objection period. Candidate: It is every Iraqi was accepted officially nominated by the Independent Electoral Commission for the membership of the Iraqi Council of Representatives. Open list: is the list containing the names of the candidates declared and under which the voter is granted the right to elect whom he deems appropriate , without being bound by the order within a single candidate list. The list of individual: is the list that consists of one candidate and under which an individual is entitled to one to run for the elections to be registered with the Commission. Constituency: Each is a specific area have been allocated a number of seats in accordance with the provisions of this law. Election Center: the place designated by the Commission within the electoral district for the purpose of conducting the voting process and contains a number of polling stations. Polling Station: the place designated by the Commission within the election center to vote voters , which requires a number of voters designated by the Commission. Armed Forces: Iraqi army formations and military personnel working in the Defense Ministry or any formations or affiliates and a counter - terrorism and the popular crowd circles and any military device last. Security services: Ministry of Interior and its formations and members of the Department of the security services and any departments or subordinate formations and apparatus of the Iraqi National Intelligence Service and the Chancellery of the National Security and the National Security Apparatus and any other security device. Article - 2 - The text of Article (7) of the Act and replaced by the following: Article - 7 - First : setting the election date by a decision of the Council of Ministers in coordination with the Independent Electoral Commission and issued a presidential decree to be announced by means of various media ahead of time to hold them no later less than (90) days. II - The House of Representatives must take place before the elections (45) days after the end of the previous election cycle at least date. Article 3 The text of Article (8) of the Act and replaced by the following: Article 8 A candidate First : the membership of the House of Representatives in addition to the conditions that must be provided in the voter provided for in Article (5) of this law , the following: 1. Iraqis completed a full - fledged (30) thirty years of age at the nomination. 2. holds a university degree or its equivalent at the nomination. 3. The candidate should not be convicted of a felony non - political or misdemeanor involving moral turpitude. 4. not be covered by the law of the accountability and justice , or any other law , replace it. 5. is doomed because of the expense of home enriching public money or a final court judgment. 6. not be members of the armed forces or security services or judges or heads of independent bodies when his candidacy. 7. only be employed by the Independent Electoral Commission , including the member of the Board of Commissioners and the incumbents of senior positions with the exception of the finished work before a period of not less than (4) years from the date of nomination. Second - are not entitled to are covered by the provisions of paragraph (i / 6) of this article shall return to their jobs. Article - 4 - The text of Article 9 of the law and replaced by the following: Article - 9 - First : send the Commission the names of candidates to the Supreme National Commission for Accountability and Justice to decide within (15) fifteen days from the date of receipt and in the absence of the answer The candidate is not covered by their proceedings. Second - Candidates are subject to approval by UNHCR. Article -5- cancels the text of Article (10) of the Act and replace it Mayati: Article - 10 - The number of candidates in the list does not exceed the number of constituency seats. Article 6. The text of Article 11 of the law and replaced by the following: Article 11 First - the distribution of electoral constituencies on the basis of electoral districts for each province. II - the House of Representatives consists of (328) , three hundred and twenty - eight seats, while a census of it (318) three hundred and eighteen seats to the provinces on according to administrative borders, according to below in the table accompanying this law as you go seats (10) remaining ten as (quota) components. III gives the following components share (quota) deducted from the allocated seats combined should not affect the participation rate of Withholding components in the national lists, as follows: a. Christian component (6) , six seats are distributed at the rate of one seat to the provinces (Nineveh, Irbil, Dohuk, Kirkuk) and two seats for the province of Baghdad , one of the Armenians. B .almkon Yezidi (one seat) in the province of Nineveh. C. Component Sabian Mandaean (one seat) in the province of Baghdad d. Networking component (one seat) in the province of Nineveh , e. Kurds Faylis (one seat) in the province of Baghdad IV of the quota of seats allocated to Christians, Yazidis and Sabean Mandaean and Shabak and Kurds Faili be within a single electoral constituency. Article 7. The text of Article 13 of the law and replaced by the following: Article 13 should not be less than the number of women candidates (25%) in the list and not less than the proportion of women in the Council (25%). Article - 8 - The text of articles (14, 15) of the Act and replace them with the following: Article 14 seats are distributed to the competing entities as follows: First - divided the valid votes for each list on the serial numbers (9.7.5.3.1.6, .... etc) and the number of allocated constituency seats. II . Ensure that women take into account the (25%) at least the number of seats. III if he got two or more candidates from different lists on the votes of true equal and was ranked last in the constituency are approved by the party hierarchy adoption or political organization in the electoral list to determine the winner of the electoral seat. IV - the distribution of seats within the list to rearrange the sequence of candidates based on the number of votes obtained by each of them and be the first winner who gets the highest number of votes , and so for the rest of the candidates. V. - If a council member has his seat for any reason he was replaced by the candidate next to him in the number of votes obtained in the list within the constituency. VI . If a council member has his seat for any reason , and was part of a single list allotted the seat to another candidate holds the highest number of votes for the party or political organization or individual , got the upper limit of the votes did not get a seat. Article 9 of this law is implemented from the date of its publication in the Official Gazette.
