A US court has heard a lawsuit calling for a halt to the deportation of about 100 Iraqis who have been arrested by immigration authorities in the Detroit area because many of them belong to minorities and may face torture or religious persecution in their homeland.
In a coordinated campaign in recent weeks, immigration authorities have arrested Iraqi migrants across the country who have been given final sentences for deportation and convicted of serious crimes. This happened after Iraq agreed to accept the deportees as part of an agreement to remove it from the list of countries that President Donald Trump seeks to prevent From entering the United States.
A number of those arrested came to the United States as children and committed crimes decades ago but were allowed to stay because Iraq had previously refused to issue travel documents. But that changed after the two governments reached an agreement on March 12.
The lawsuit filed by the American Civil Liberties Union calls on the court to issue an urgent order to stop the planned deportations, saying that many of the targets in Michigan are Chaldean Christians, widely considered "targets of brutal persecution in Iraq." The union also argues that the deportation of Iraqis could be a violation Of the United Nations Convention against Torture, an international treaty signed by the United States.
The US government says the district court is not competent to hear the case and that migrants can appeal to the immigration court. The US Immigration and Tax Enforcement Administration said that of the 199 Iraqis arrested in operations across the country were convicted of criminal charges of murder, rape, assault, kidnapping, robbery, drug trafficking, Possession of arms.
The judge did not specify a date for a verdict in the case. Iraqi Kurds were also arrested in Nashville, Tennessee, but the American Civil Liberties Union said the case was not covered by the case.
Six lawmakers from the US House of Representatives from Michigan - five Democrats and a Republican - sent a letter to the Homeland Security Department urging them to stop the deportations until Congress can review the agreement between the United States and Iraq and obtain guarantees for the safety of the deportees. Hundreds of protesters outside the courtroom waving American flags and carrying Hamra and signs saying "deportation was sentenced to death"
