    The Supreme Federal Court, a lawsuit filed by the Governor of Kirkuk, Najmuddin Karim, against the former Prime Minister Haider Abadi, on the events of 16 October 2017, attributed the "lack of jurisdiction".
    The lawsuit focused on the unconstitutionality of Abadi's decisions by using the armed forces and popular mobilization to carry out a military operation in Kirkuk, canceling the consequences thereof and implementing Article 140 of the constitution and obliging him to restore the situation to what it was and allow them to exercise their normal duties to administer the governorate. The Constitution in accordance with the stages provided for and completion of the procedures from the point where it was stopped, as well as the provision of a mandate to stop the holding of parliamentary elections in Kirkuk until the restoration of security and stability.
    The court said that the first request related to the administrative decision taken by the defendant in addition to his job to restore security and stability to the province of Kirkuk, and that this decision is outside the jurisdiction of the court specified in Article 93 of the Constitution and article 4 of its law No. 30 of 2005, which requires a response to this request on the one hand Lack of jurisdiction.
    She added that she finds that the second request does not have the competence to oblige the defendant to perform a certain act or to refrain from doing a particular job, including what is stated in the application by obliging him to implement Article 140 of the Constitution. Therefore, this request is outside the jurisdiction of the Federal Supreme Court. , Stressing that the third request has become irrelevant subject to the conduct of parliamentary elections in all of Iraq, including Kirkuk.
