The French Justice Ministry said it would not respond to US President Donald Trump's demands for the return of French fighters when he urged detainees in Syria.
The German Interior Ministry announced that its country could not restore elements calling on detainees in Syria unless they were allowed to visit consulates, thereby reducing the possibility that Berlin would meet a request from European allies to receive them.
A spokeswoman for the German Interior Ministry said in a press statement on Monday that "Iraq has shown interest in the trial of some Da'ash fighters from Germany and initially all German citizens and suspected murderer besides the so-called Da'ash has the right to return," he said.
But added that this was conditional on allowing consular officials to visit the suspects.
"But in Syria, the German government can not guarantee the legal and consular duties to be done against German citizens imprisoned because of the armed conflict there," she said.
German authorities say about 1050 people have traveled from Germany to Syria and Iraq since 2013 and about one-third have already returned to Germany.
On Saturday, the US president called on Britain, France, Germany and other European countries to receive more than 800 European nationals who had been detained in areas controlled by Washington's allies and threatened that the United States would be forced to release them if European countries refused to receive them .
