He added that "the constitution stipulated: First - In the first clause of the book (detainees), it did not bring anything new, as the investigation courts release any arrested person. The law allows the release of bail on bail according to the legal permissibility according to the law and this is in effect even before the emergence of the Corona virus pandemic."
He added, "Mr. President demanded that cases covered by the previous amnesty should be resolved, while all those covered by the previous amnesty law had their cases resolved, except for those who did not meet the conditions for inclusion in the amnesty."
Al-Abadi continued: "Secondly, second clause of the book (the ruled), stipulates a request for the speedy release of the ruled prisoners who have completed their sentence and were not released if they were not wanted for other cases, while the law criminalizes this act, if any."
The expert said: "With regard to the subject of applying the conditional release according to Article 331 of the Code of Criminal Procedure (Courts of Appeal apply this text exceptionally despite the curfew and the judiciary announced this in the media), however, the courts apply this text previously."
He explained: "- Item Three of the book (Special Pardon), explains what the book mentioned in the Constitution stipulated in Article 73 / First and its text: - (Issuing a special pardon upon the recommendation of the Prime Minister except for the special right and those convicted of international crimes, terrorism and financial and administrative corruption." .
