[size=45]The House of Representatives intends to turn the page on the Federal Supreme Court’s law early next week after talking about an agreement on most of its remaining articles through proposals stipulating that the role of Sharia experts be limited to cases related to violating the provisions of the principles of Islam. And dispensing with the right of veto.[/size]
[size=45]Meanwhile, political dialogues in the coming hours will focus on resolving a quorum for decision-making, with a tendency to adopt a two-thirds majority to guarantee the rights of small components.[/size]
[size=45]Member of the Legal Committee, Representative Saeb Khadr, says that "the file of the Federal Supreme Court is very important as it relates to drawing features of judicial work in Iraq and the authority concerned with interpreting constitutional texts and settling disputes between federal authorities, regions and governorates."[/size]
[size=45]"The first affected by this court are the Iraqi components and groups of people, and it has a geographical dimension to the regions and governorates," Khadr said, in an interview to (Al-Mada).[/size]
[size=45]He pointed out that "the small components should preserve their vision in this supreme judicial body concerned with constitutional issues."[/size]
[size=45]Khadr indicated that "a meeting was held with the Presidency of the House of Representatives and the political blocs and was attended by representatives of minorities, which resulted in a clear rapprochement."[/size]
[size=45]He pointed out, "There has been a kind of understanding among all of the necessity for the components and minorities to be represented in the Federal Supreme Court, and to find a solution to the dispute over the role of Sharia experts and legal scholars."[/size]
[size=45]And Khadr reported, “Most of the disputed articles of the law will be resolved before Monday’s session; Because we saw that there were obstacles to overcome in voting on the project, which is a good thing and gives positive impressions.[/size]
[size=45]But he stressed "the need to guarantee the civil and moderation of the state, and the political, economic or social rights stipulated in the constitution for all groups of the Iraqi people, especially with regard to small components, and to respect the Iraqi environment in general."[/size]
[size=45]Khadr explained, "The general trend of the Legal Committee is to limit the role of Sharia experts to issues related to violating Islamic law, while legal scholars have their role in issues related to human rights, freedoms and public rights, and thus we will achieve a balance." And he added, "The dispute will move to the voting mechanism, which is also subjected to discussions and we have come to ideas through which we will achieve democracy without granting any party the right of veto."[/size]
[size=45]A member of the Legal Committee spoke about "two opinions on the issue of a quorum of decision-making, the first with a majority of the +1 half, and the other with the two-thirds, which is likely to preserve the concerns of the components, especially minorities."[/size]
[size=45]Khadr indicated that "the presence of Sharia experts and legal scholars in the Federal Supreme Court is based on the constitution that stipulated them in Article 92 alongside the judges, and it is binding on us."[/size]
[size=45]And he continues, "representatives of minorities raised their concerns during the meeting of the leaders of the blocs and demanded that the role of Sharia experts and legal scholars be consultative, but in the end the text of the law will be according to what the talks reached in accordance with the constitution."[/size]
[size=45]Khadr went on to say that "discussions will continue until the last moments before next Monday's session, which we hope will witness the vote on the law in a manner that meets ambition and preserves the Iraqi judicial system."[/size]
[size=45]The enactment of the Federal Supreme Court law requires a two-thirds majority vote on every article therein, and the enactment of the law as a whole, that is, the approval of no less than 220 deputies.[/size]
[size=45]For his part, Deputy Chairman of the Legal Committee, Representative Muhammad al-Ghazi, said in a statement to (Al-Mada), "The House of Representatives voted in two previous sessions on 21 articles of the law, and we have only three articles left."[/size]
[size=45]Al-Ghazi added, "Two articles of the disputed issue have been agreed upon, and we have only one article left that will witness meetings and discussions, and we can also finish so that we hold a decisive session of the law either on Saturday or next Monday."[/size]
[size=45]He pointed out, "The House of Representatives is moving towards voting on the law, and recent meetings have witnessed a clear convergence of views, and we have taken note of the concerns of minorities, and we will work on enacting texts that guarantee their rights."[/size]
[size=45]Al-Ghazi concluded, "This law is gaining its legislative importance, especially with the intention to hold early elections next October, and the acceleration of its legislation comes to ensure the presence of the supreme judicial authority that ratifies the results according to the text of Article 93 of the Constitution."[/size]
