    The federal government’s move to send 200 billion dinars per month to the Kurdistan region retroactively as benefits in the federal budget for the current year provoked different political reactions, at a time when a former Kurdish representative indicated that the government’s decision was legal, constitutional and based on a ground of meetings and dialogues between the region. And the Center, another warned of the legal consequences of violating the government that may lead to questioning and dismissal.


    A measure that may topple the government, a
    member of the House of Representatives from the Al-Fateh coalition, Abdul Amir Taiban, confirmed that the legal and constitutional violation of the government in the case of sending sums of money to the Kurdistan region retroactively, subject it to accountability, hosting and interrogation within the House of Representatives and may topple the government.






    Taiban said in an interview with Alsumaria News, "The government's behavior and sending sums to the Kurdistan region is an explicit violation of the articles and provisions of the 2021 budget, especially Articles 10 and 11 of them, which included a number of mutual rights and obligations between the center and the region," noting that "the regional government until today." It did not abide by its duties, and therefore the retroactive delivery of any sums by the center to the region is a constitutional and legal violation.”

    Taiban added, "The legal and constitutional violation by the government exposes it to accountability, hosting and interrogation within the House of Representatives, and it may overthrow the government if it does not adhere to the law," noting that "the House of Representatives is obligated to stop these violations and violations, with the government obligating the provisions of the budget articles that were voted on by a majority ".


    He pointed out that "the government's failure to abide by the law on various pretexts does not absolve it from legal accountability, and will expose it to procedures that may lead to dismissal."

    A constitutional and legal position
    , for its part, the former representative of the Kurdistan Democratic Party, Najeba Najib, indicated that the region's commitment to implement its obligations within the budget and mutual visits have prepared the ground for the release of the region's budget dues in accordance with the constitution and the law.

    Najib said in an interview with Alsumaria News, "The government's position in sending sums to the Kurdistan region is not a violation of the constitution and the law. On the contrary, it is an application of the provisions of the Iraqi constitution in Article 121, the third paragraph, in addition to other constitutional articles, not to mention the Federal Budget Law for the year 2021 in its eleventh article. Ten," noting that "the government and the parliament worked to implement the budget articles and did not violate them, and it is a constitutional commitment of the Council of Ministers towards the Kurdistan region."

    And she added, "The government was obligated to send the entitlements of the people of Kurdistan and the salaries of employees, like the rest of the Iraqi state employees, on the grounds that it represents the food of people who have not received their salaries for a year and three months."

    Najeeb pointed out that "after the successive meetings that took place between the federal ministries and their counterparts in the region, in addition to the Office of Financial Supervision in Baghdad and the region, and after checking all data related to the region's oil and non-oil revenues, and after all the relevant paragraphs of the budget in its eleventh article were implemented, the floor has become Prepared to hand over Kurdistan's entitlement from the budget by the Council of Ministers.
