Shafaq News / The independent deputy, Basem Khashan, announced on Wednesday the appeal to the Federal Court against the decision of the Presidency of the Iraqi Parliament, No. (4), which includes opening the door for candidacy for the post of President of the Republic again.
Khashan said, in a statement received by Shafaq News Agency, that "the decision was issued because it violates Articles (59/second) and (72/second/b) of the constitution and Article (2) of the Law on the Provisions of Candidacy for the Post of President of the Republic," noting that he had asked The court "issued a state order to stop all procedures resulting from this decision."
In this context, Khashan affirmed that an appeal was submitted against the decision of the Presidency of the Council to refrain from calling for the convening of the Council during the last days of the inevitable constitutional period for electing the Speaker of Parliament, 8/2 2022, nor on any other day.
He continued, "I referred to Federal Court Decision No. (51 / Federal / 2010), which I see as a grave violation because it enables the president and the government to continue to exercise their duties for four years, if a third of the members of the Council adhere to boycotting the sessions."
The presidency of the Iraqi Council of Representatives decided to open the door for candidacy for the position of President of the Republic, starting from Wednesday, February 9, 2022 for a period of (3) days, after it failed to elect a new president for Iraq after most of the parliamentary blocs boycotted the session due to differences based on this position, and over naming the largest bloc resulting in the formation of the next federal government.
On Wednesday, the Legal Adviser to the Legislation Department in the House of Representatives, Ghazi Faisal, presented the legal points that prompted the Iraqi parliament to issue a decision to re-nominate the presidency, a decision that angered several political forces.
Faisal said in a statement, received by Shafaq News Agency, that the Presidency of the House of Representatives issued the aforementioned decision, in which it decided to re-run the nomination process for the position of President of the Republic as another ball, relying on the provisions of the Nomination Law for the Position of President of the Republic No. (8) of 2012.
