It is expected that Parliament will hold a special session next week to reopen the door for nomination to elect the President of the Republic “again”, after the Federal Court issued a decision unconstitutional of the Parliament’s decision to open the door for nomination “a second time” and demanded that the decision to open the door for nomination be through the vote of deputies in a session For Parliament, a quorum of “half plus one” of members is achieved, according to parliamentarians.
Parliament member Hadi al-Salami expected in an interview that “the parliament will hold its session in this regard next week,” and indicated that “independent deputies are ready to attend at the time that is set for the session, but it is up to the Speaker of Parliament to determine the timing of the session,” and explained that “political parties realize that The situation cannot be delayed, and the street is congested because of political conflicts, and people’s interests and work have stopped due to the lack of a budget with which many things are related.”
In addition, the legal expert, Ahmed Al-Abadi, stated in an interview, that “the Federal Court did not specify a time period for holding a session of Parliament in order to open the door for nomination for the presidency of the republic, but rather stipulated that the vote should be by the representatives and not the presidency of Parliament, which is a final and binding decision,” noting that “ In the event that a parliamentary session is not held, the situation will remain as it is now.”
In turn, political analyst Iyad al-Anbar explained in an interview with "Al-Sabah" that "the Federal Court did not give an order to hold a session to open the door for nomination, but rather confirmed that it is not possible to open the door for nomination by a decision of the Presidency of the House of Representatives, but rather by a voting session for the House of Representatives."
He added that "the problem is not with holding the session, but with the issue of two-thirds of the election of the president of the republic, and opening the door for candidacy may be justified easily, but the problem of quorum continues."
In turn, the representative of the State of Law coalition, Muhammad Al-Shammari, said in an interview: “The Federal Court’s decision referred the decision to reopen the nomination for the position of President of the Republic to the House of Representatives, and a session will be held to vote on that based on the court’s decision that established the matter in the Council, not its presidency.”
He added that "the date of the session will be associated with the timings and its date will be issued by the presidency of the Council, and the ruling will be easy because it is associated with "half plus one" and not achieving two-thirds like what is in the election of the president of the republic, which is difficult to achieve without a political agreement."
He stressed that "it is possible to solve all problems easily, and the positions of the President of the Republic, the Prime Minister and the government can pass in the event of an agreement on the coordination framework and the Sadrist movement, and this agreement will generate smoothness in naming positions."
For his part, the political analyst Ghaleb Al-Damay said in an interview with Al-Sabah that “the opening session for nominations for the position of President of the Republic will likely pass, because the Triple Alliance has a simple majority of 166 deputies, and the nomination window will be opened, after which a session will be announced to elect the President of the Republic.”
It is likely that “the House of Representatives will face a problem in achieving a quorum by two-thirds of its members in the matter of electing the President of the Republic, which takes place in two stages, the first is achieving a quorum and the second is the election with the highest votes.”
