    [size=45]In connection with what we previously announced about the lawsuit that we filed before the Federal Supreme Court on 4/19/2022 against the Speaker of the Iraqi Council of Representatives (in addition to his position) for the Council’s reluctance to elect the President of the Republic in preparation for the formation of the new government, we are interested to announce that this lawsuit (110 / federal / 2022) became ready for consideration by the Federal Court on the date that the court had set, which is 5/6/2022.[/size]
    [size=45]On May 15, 2022, on our part, the response list to the list in which the House of Representatives responded to our lawsuit was handed over to the Federal Supreme Court.[/size]
    [size=45]Since the legal department in the General Secretariat of the House of Representatives paid in a list of its response that the plaintiffs’ interest was not achieved, and they are the first secretary of the Iraqi Communist Party and the Secretary-General of the Iraqi Nation Party (in addition to their jobs), there is no immediate, direct or influential interest in their legal status, and they did not provide evidence of damage Realistic and direct. As stated in the regulation that, based on this, the plaintiffs' request is outside the jurisdiction of the Federal Supreme Court, which is contained in Article (93) of the Constitution.[/size]
    [size=45]The list of the lawsuit submitted by us indicated the reluctance of the Parliament to implement Article (72 / first / b) of the Constitution of the Republic of Iraq, which obliges the Parliament to elect the President of the Republic within thirty days from the date of the first session of the Parliament.[/size]
    [size=45]In response to the parliament’s answer list referred to above that the plaintiffs’ interest was not achieved, what was included in the lawsuit petition was repeated that the plaintiffs lead two parties that include thousands of citizens. Therefore, they are concerned with the harm caused to citizens as a result of the Parliament's reluctance to abide by the constitutional deadlines to complete the formation of the government.[/size]
    [size=45]It was pointed out regarding this damage, for example, to the absence of the federal budget of the state so far, and therefore the failure to allocate and disburse the amounts required to secure the needs of citizens. We also mentioned that the Federal Supreme Court, through the exercise of its functions, has the general jurisdiction to monitor the implementation of the provisions of the Constitution.[/size]
    [size=45]In our list, a reference was made to a text contained in the Federal Court’s decision in the case (23 and its unit 25 / Federal / 2022) which states:[/size]
    [size=45](It is assumed full adherence to the provisions of the constitution, given that the constitution gives legitimacy to the federal and regional state institutions. Otherwise, these institutions lose their legitimacy).[/size]
    [size=45]Reference is also made to what was stated in Paragraph (2) of the same resolution: (Provided that the President of the Republic will be elected within a short period commensurate with the will of the constitutional legislator and the supreme interest of the people, which necessitates completing the formation of the federal authorities within the constitutional entitlements stipulated in the Constitution, provided that it does not affect that the procedures of the first nomination that took place within the legal periods).[/size]
    [size=45]Based on all this, we look forward with hope to next June 5, and the session that the Federal Court will hold in it to consider the lawsuit that we submitted to it last month.[/size]
