The Iraqi Bar Council decides to change the mechanisms for granting power and adds two different powers in accordance with the provisions of the law:
The Bar Association stated in a statement it received / Mawazine News / a copy of it, that "the changes are as follows:
First: The Iraqi Bar Council decided, in its session held on 15 / 6 / 2022, changing the mechanisms for granting authority and ways to expand it, based on the provisions of Articles (18, 19, 20, 21) of the Iraqi Advocacy Law, No. 173 of 1965, the amended effective, and for the purpose of activating the true value and solid foundations of the capacity of the lawyer
. Lawyers’ powers are of five types (trained, A, B, C, and divorced)
Third: The powers referred to above are granted according to the following conditions:
1- The lawyer submits with his affiliation papers a written request that includes choosing the method of expanding his authority, from among the two methods:
A- Exercising .
b- Graduation.
2- If the lawyer chooses the (exercise) method, the authority shall be granted according to the following:
A- He writes in the identity of the lawyer when his affiliation is accepted, in front of the validity field the phrase (trainee)
B- The trainee lawyer joins the training for two years in the office of a lawyer who has practiced law for a period of no less than five Years. And they - the trainee and the apprentice - must submit to the union an acknowledgment of this signed by them.
C - After the end of the training period, which amounts to two years from the date of the start of the training, the lawyer submits a request to the Bar Council to expand his authority, and based on the provisions of Article 21/1 Law Firm, the application must be accompanied by:
- A statement of the lawsuits in which he pleads certified by the court that examined She has these cases.
A confidential statement from the intern attorney, including his opinion of the intern attorney’s competence and behavior in the legal profession, the work he has practiced, and his recommendations regarding the termination or extension of the internship period.
D.- The Bar Council, upon the request of the intern lawyer, decides to end the training period and to register his name in the list of lawyers with (absolute) authority, and then he has the absolute authority to practice law before all courts and other bodies.
e- After the council’s decision to accept the extension of authority, the phrase “Absolute” is written in the lawyer’s ID, in front of the authority field.
3- For those who choose the second method of extending the validity, which is
(graduation) in validity for a period of no less than (3) years, follow the following:
A- Write in the lawyer’s identity at the beginning of his affiliation, in front of the validity field (A).
B - After completing a full year from the date of affiliation, the lawyer has the right to submit a request to the Bar Council to expand his authority to (b) and attach with the request (10) documents proving his practice of any of the legal professions such as (judicial decisions, powers of attorney, company registration documents...etc) in addition to To his participation in the virtual court session set up by the union, and after the council’s approval, he writes in the identity of the lawyer, in front of the authority field (b).
C- After completing a full year from the date of granting the authority (B), the lawyer has the right to submit a request to the Bar Council to expand his authority to (C) and attach with the request (10) documents proving his practice of any of the legal professions, in addition to his participation in the virtual court session held by the Syndicate After the council’s approval, he writes in the identity of the lawyer, in front of the validity field (c).
4- A lawyer who has completed (5) years from the date of his affiliation, and after fulfilling the conditions for internship, has the right to submit a request to the Bar Council, to expand his authority to (divorced), and after the approval of the Council, write in the lawyer’s identity, in front of the authority field (absolute), and include his name In the Roll of Lawyers with Absolute Power.
5- Two tables of lawyers shall be printed:
a- The list of lawyers with limited competence.
2- The Roll of Lawyers with Absolute Power.
6 - This decision shall be implemented from the date of its issuance, and shall not have a retroactive effect.
7 - The Syndicate will announce later the details of the virtual court sessions, their scientific materials, and their mechanism. Ended 29/h
