Yesterday, Friday, Iraq welcomed the decision of the German parliament to consider the crimes of the terrorist organization "ISIS" against the Yazidis as "genocide", in a move that the families of the victims and the missing hoped would shed light on their cause internationally.
The President of the Republic, Abd al-Latif Rashid, said in a tweet on Twitter: "We welcome the German parliament's approval of considering what happened to our Yazidi people at the hands of the terrorist ISIS as genocide against humanity."
Rashid called on "the international community to ensure that the perpetrators are punished and to make efforts to reveal the fate of the rest of the abductees, not to repeat such crimes in the future, and to secure the return of the displaced to their areas and homes."
In turn, the Deputy Speaker of the House of Representatives, Shakhwan Abdullah Ahmed, welcomed the German decision, and pointed out in a statement to "the importance of this decision and the German step, as it includes measures and procedures aimed at eliminating the effects and repercussions of the genocide," calling on the international community to "provide support and assistance to Iraq." Efforts to reveal the fate of the kidnapped, rebuild Sinjar, provide basic services and infrastructure, and compensate those affected financially and morally.
German deputies approved a memorandum yesterday, Thursday, classifying what the terrorist organization "ISIS" committed against the Yazidis in northwestern Iraq in 2014 as "genocide", and recommended a series of measures to help this minority, and the text presented by the ruling coalition and the conservative opposition was approved unanimously. Representatives present.
And it stated that "the primary goal of ISIS was the complete elimination of the Yazidi community," adding that "more than 5,000 Yazidis were tortured and brutally killed by the terrorist organization, especially in 2014."
The German memorandum added that "girls and women were subjected to enslavement, rape and sale," and indicated that "sexual violence. Its aim is to strip communities of their humanity, humiliate and fragment them," and accordingly, "the House of Representatives (Bundestag) considers the crimes committed against the Yazidi community as genocide."
The document of the German parliament stipulates a series of demands directed at the German government, from prosecutions against suspects in Germany and financial support, in addition to collecting evidence in Iraq, to rebuilding destroyed Yazidi housing complexes.
In addition, the head of the "Islamic University / Babylon branch", a professor specializing in international humanitarian law, Dr. Haider Kazem Al-Quraishi, said: "The primary role of the United Nations is to determine the legality of war or not, that is, to indicate when the use of force is legitimate, which is called in the jurisprudence of international law." With (the right to war), while it is not considered one of the tasks of the United Nations to work on conditioning, characterizing and criminalizing crimes, the latter is subject to a judicial body (an international or national court, depending on the case), and therefore it is not considered a priority for the United Nations to characterize what was committed against the Yazidis as genocide collective.”
He explained that "perhaps the characterization of what was committed against the Yazidis as crimes (genocide) finds its basis in the statute of the (International Criminal Court) and the aforementioned court prosecutes its perpetrators," noting that "Iraq was unable to prosecute the perpetrators of these crimes because it is not a member state of the The basic system of the aforementioned court, and it is also impossible to obtain the agreement of the five permanent members of the Security Council collectively to refer the matter to the criminal court.
Al-Quraishi presented two options for Iraq to proceed with the prosecution of "ISIS" in the Yazidi genocide file. The first is the enactment of a local national law that is complemented by the harmonization of relevant international humanitarian agreements. For his part, human rights expert Dr. Ali Al-Bayati considered, in an interview with Al-Sabah, that the decision of the German parliament “is a prelude to the German judiciary in order to investigate and file cases against the perpetrators, whether those who have German citizenship or those who are on German soil of other nationalities, as well as the establishment of And the formation of a documentary center documenting these crimes, allocating funds to investigate these crimes in Iraq and Syria, and helping the Yazidi community to rehabilitate what they lost at the level of infrastructure, individuals and society.
As for the director of the Iraq Center for Human Rights, Ali Al-Abadi, he saw in an interview with Al-Sabah that “this decision is fair to the Yazidis, and contributes to preventing the recurrence of such acts and terrorist crimes against minorities, including the Yazidis, and constitutes international recognition of what happened to them in terms of the genocide that resulted from it.” Trials and rights.
