Parliamentary movement to amend the retirement law and return the service age to 63

Baghdad / Hussein Hatem
The Legal Committee in the House of Representatives seeks to amend the unified retirement law and restore the age of the retiree to what it was before 2019.
The committee revealed the existence of cooperation between the government and the House of Representatives to amend the law, while noting that the delay in the law does not mean neglecting it and that it is still in the stage of preparation and maturity.
In 2019, the House of Representatives voted on the first amendment to the Unified Retirement Law No. (9) of 2014, in which it was stated that the employee must be referred to retirement in one of the two cases, first when he completes (60) sixty years of age, which is the legal age for retirement regardless. For the duration of his service, and secondly, if the official medical committee decides that he is not fit for service.
A member of the Parliamentary Legal Committee, Aref Al-Hamami, says, "The retirement law is still within the corridors of the House of Representatives, and has not reached its final stages yet."
Al-Hamami added, "The Legal Committee intends to amend some paragraphs of the law, including the legal age, which has received many objections and observations."
A member of the Legal Committee pointed out that “there is cooperation between the government and the House of Representatives to amend the retirement law,” noting that “the delay in the law does not mean neglecting it, but rather it is still in the stage of preparation and maturity.”
He hinted at, “Returning the age of the retired to 63 years, through the new amendment that will be discussed by Parliament.”
For his part, the other member of the committee, Raed al-Maliki, says, “The amendment of the unified retirement law has many questions,” adding, “In the event of amending the law, the problem of retirees who have been referred to retirement appears, and in the absence of an amendment, it requires some kind of compensation.”
Al-Maliki added, "The financial cost is estimated by the government because there are many segments such as social welfare, new appointments, and confirmation that are included within the financial abundance," expressing his hope that "the pension salary will be similar to the full job salary."
He explained, "There are ages lost by departments and institutions such as the Ministries of Education and Health. In contrast, the retirement age of some other institutions, such as the Interior and Defense, must be reduced," noting that "adjusting the retirement age is related to functional reasons and not for retirees."
Al-Maliki pointed out that there is a problem with “the wrong application of the retirement age at sixty,” adding that “a year is stolen from them, because what happens is reaching sixty, not completing it.”
For his part, another member of the committee, Omid Muhammad, revealed that “there are parliamentary calls to amend the retirement law, raise the ceiling of the minimum levels of retirees’ salaries, and restore the age of the retiree to 63 years.”
And Muhammad added, “The amendment of the law is represented by two axes: As for collecting 10 signatures within the House of Representatives and presenting the amendment to the Presidency, after which it is referred to the legal committee for consideration, and the second axis is that the amendment comes from the government.”
And he pointed out, “Any amendment to a law that has a financial side must take the government’s opinion of approval or rejection.”
In late November 2022, the Iraqi Prime Minister, Muhammad Shia' al-Sudani, revealed the government's efforts to increase the salaries of retirees.
Al-Sudani said, in his weekly conference at the government palace, that "the previous amendment to the retirement law took place in unstable circumstances, and when she was a member of parliament, she refused this amendment."
He added, "There is a study by the government on increasing the salaries of retirees, and we are continuing to discuss the federal budget law for the year 2023."
