Parliamentary Legal: Those convicted of corruption and terrorism cannot be pardoned

The Parliamentary Legal Committee revealed that the demands for a new general amnesty law are logical to overcome the mistakes of the previous law, as it is within the agreement of the powers of the state administration, but this amnesty must be according to conditions and does not include murderers and thieves of public money, otherwise it will be challenged for being contrary to the constitution.
A member of the committee, Raed al-Maliki, told Al-Sabah: “The enactment of a general amnesty law is a paragraph in a political agreement with the forces of state administration, but it is not known what formula it will be presented in, because if it is similar to the law that was enacted in 2016, there will be A problem because the law allowed for a retrial, and this is a derogation for the judiciary because it was challenged when it said that previous trials were not real and confessions were extracted under duress.
He added that "enacting a law to pardon people is not possible because they can be pardoned directly without the need to accuse the judiciary of ruling under coercion," noting that "the political forces can say that for the sake of political interest we decided to pardon those accused of terrorism if this is required."
Al-Maliki explained, "The pardon must have its justifications because in all countries of the world there are groups of those who have learned the lesson for which they were sentenced to imprisonment or something else, and therefore it is desirable that their pardon be according to conditions," adding that "the constitution prohibits amnesty for terrorism and crimes." Financial and administrative corruption, pointing out that if a law is enacted to release terrorists or corrupt people, we will challenge it because it violates the constitution, and the two crimes are not covered by amnesty within the constitution.
