The “general amnesty” law pending political consensus

The general amnesty law, which has been talked about for a long time in the past months, is still the focus of attention for those interested because of its importance at the governmental and popular levels, and while it was announced last year 2022 that there was a consensus on the legislation of the law, its details and amendments are still a matter of disagreement between the active political parties.
A member of the Parliamentary Legal Committee, Representative Muhammad Anouz, said in an interview with "Al-Sabah": "The proposal to amend the general amnesty law was before the Legal Committee since last year, and it was discussed and submitted to the Presidency of the Council this April."
He explained that "the law is part of the political agreement between the parties (the State Administration Coalition), and therefore they are the ones who will decide when it is presented or studied. As for the Legal Committee, it submitted a proposal for amendment, but the government may submit a draft law amendment from it," and indicated that "the Legal Committee conducted Dialogues with the President of the Supreme Judicial Council and some parties to determine the general direction in the law, so that a fair amnesty law is enacted for those who have been subjected to harm and imprisonment without real evidence, as the law relates to those whose sentences have been executed and a long period has passed and only a small part of their punishments that can be imposed It turns into alternative penalties, such as paying sums of money for each day of detention to release them, if they do not cause harm to society.”
Member of the Legal Committee, Yahya Al-Muhammadi, explained in an interview with Al-Sabah that “the general amnesty law is among the important laws that are considered among the priorities of (the State Administration Coalition) and the Prime Minister, who promised on more than one occasion his commitment to implement this law, and he formed a committee within the parliament Ministers in order to prepare a bill to amend the law and send it to the House of Representatives.
He added, "There is consensus towards enacting the law. Indeed, the Sunni component is a major supporter of enacting and amending the law, because we believe that there are many innocent people inside prisons who need to be re-investigated and tried in order to release them."
Al-Muhammadi indicated that "there are prisoners in the judicial departments or in Iraqi prisons who need a pardon in order to turn a new page, and this is applicable in all countries of the world, and the Minister of Justice on more than one occasion affirmed his support for the legislation of the law in order to reduce overcrowding in prisons to implement international human rights standards." that apply to Iraqi prisoners, so the government must be obligated to legislate and implement the law.”
On the other hand, the spokesman for the Ministry of Justice, Kamel Amin, explained in an interview with "Al-Sabah" that "there is an interest in the government - and it is presented within the political agreements - in studying the legislation of an amnesty law that contributes to several tracks, including the political agreement and calming the general situation in Iraq in addition to Reducing the problem of prison overcrowding.
He added, "The government has a balanced vision in this regard, which is not to push the amnesty law so that there is impunity, and at the same time not to disturb the political climate and direct the government to reconstruction and the provision of services that need in return to calm the situation."
Amin indicated that "the role of the Ministry of Justice is very limited in this matter and it is ready to cooperate by providing details of inmates and depositors with it according to the type of sentence and crime and at all levels if it is misdemeanors or felonies and related to terrorism, and the Ministry is ready through the solid information base that it possesses in addition to the presence of qualified employees." Especially the middle degrees of working with the sub-committees and providing accurate and legal information about the inmates, and it is difficult to include the amnesty unless the judgments have gained the final degree and taken their decision.” And between the discussions and dialogues, the issue of amending, detailing, and enacting the general amnesty law remains dependent on political consensus between the parties to the State Administration Coalition.
