    Many legal experts and the political, executive and legislative authorities in Iraq agree that there are cases of injustice in prisons, whether in arrest and during investigation, or after the ruling and placing the convicts in the prisons of the Ministry of Justice. There is much evidence of this, perhaps the most prominent of which is the conviction of a person for killing his wife after he confessed to this beforehand. To discover that she was alive and not dead, it turned out that the confession came under torture, which is a famous incident that spread in 2021, so much so that Prime Minister Mustafa Al-Kadhimi met at the time with the person who was subjected to torture and made the false confession, and legal measures were taken at that time by the security forces responsible for the incident .
    While many of these cases appear in detention centers affiliated with the security forces and during the investigation phase, it is rare for a similar case to emerge involving convicts who are serving their sentences in the prisons of the Ministry of Justice, especially since the court’s decision is considered a final ruling. However, there are some cases for retrial that may be possible. That the ruling can be overturned . 
    These cases are stipulated in Article (270) of the Iraqi Code of Procedure.  
    It includes many cases, such as if the accused was convicted of murder and then the plaintiff who killed him was found alive, or if a final judgment was issued against a person for committing a felony or misdemeanor only and then a final judgment was also issued against another person for committing the same crime. This means that one of the convicts is acquitted, or if A judgment was issued against a person based on the testimony of a witness, an expert opinion, or a document, and then a final judgment was issued against the witness or expert, punishing perjury for this testimony or opinion, or a final judgment was issued that the document was forged, or if after the ruling facts or Documents were submitted that were unknown at the time of the trial This would prove the innocence of the convict, and also if the ruling was based on a ruling that was overturned or annulled thereafter through the legally prescribed methods, or if the court had issued a ruling of conviction or acquittal or a final decision to release or something similar for the act itself, whether the act was an independent crime or Circumstances, and if the crime or punishment was imposed on the accused for any legal reason .
    In this case, questions arise about how to compensate the person harmed by the ruling, then his innocence is revealed, and the possibility of financial compensation can be made .
    Legal expert Ali Al-Tamimi said, in an interview with “Baghdad Al-Youm,” that “financial compensation for those sentenced to invalid sentences, after many years have passed since their imprisonment, requires the enactment of a law obligating the relevant authorities to provide such compensation. Iraq does not have this law, which is... It is present in most countries of the world.
    He stated, "There are many prisoners who spent long years in prison, and after they were retried they were released, but after their release, they were not given any compensation rights for those years, even though he lost his life. Therefore, the House of Representatives is required to legislate such a law."
    He explained that "a few years ago there was an idea and intention to legislate such a law, but political differences over it canceled the proposal at the time."
    The matter is not related to the lack of compensation for many years, but even for those sentenced to death, and even after the execution of the sentence, the discovery of the innocence of the executed person will not change anything, according to what specialists confirm .
