    Iraqi women are waiting for the “Domestic Violence” Law to be passed by the country’s legislative authorities, to bring justice to them after the rise in the number of “violated women.” Specialists believe that the only solution to deter this phenomenon is to pass the law, while “women” wonder about their rights within the framework of Iraqi law? “Baghdad Today” transmits the question to legal expert Ali Al-Tamimi to explain women’s legal rights.  [You must be registered and logged in to see this image.]
    Violence punishment 
    Today, Thursday (November 2, 2023), legal affairs expert Ali Al-Tamimi explains the penalty for “violating a woman” by a husband, father, or brother according to the law.
    Al-Tamimi told Baghdad Al-Youm, “According to the applicable Iraqi law, if a woman is subjected to violence by her husband, father, or brother, her sentence ranges from one year to three months, and the judge may decide to sentence her to several months. This depends on the details of the case.”
    He pointed out that “any violence against a woman from anyone close to her that occurs during her (permanent disability) carries a penalty of up to 15 years,” stressing that “any woman subjected to violence has the right to resort to the competent authorities, whether security or judicial, to file a complaint.” Pointing out that "there are many complaints of violence against women in Iraqi courts." 
    Civil movement 
    Activists and human rights activists are seeking to push for the “Combat Domestic Violence” bill to be put before Parliament for a vote again, in light of the increasing cases of domestic violence in Iraq, and the absence of clear and firm laws to solve the problem.
    In 2021, Iraq recorded 5,000 cases of violence against women in Baghdad and the rest of the governorates, according to the High Commission for Human Rights. 
    Earlier, the Public Relations Department of the Supreme Judicial Council reported statistics on the rates of domestic violence regarding children, women, and the elderly during the year 2021-2022, recording an increase in the number of its lawsuits, especially during the period of the Corona pandemic and its aftermath.
    The statistics stated that “the courts registered during the year 2021, the year in which the Corona pandemic spread significantly (1,141) cases of domestic violence against children, and the Baghdad Al-Karkh Court of Appeal had the largest share with (267) cases, while the number of violence cases involving women was ( 18,602 cases, while cases of abuse of the elderly amounted to (2,622) cases, of which the Babylon Court of Appeal registered (426) cases.
    The statistics for the first half of 2022 indicate that “the number of domestic violence lawsuits reached (10,143) lawsuits, distributed among (500) lawsuits for violence against children, (7,947) lawsuits for violence against women, and (1,696) lawsuits for violence against the elderly.”
