Today, Wednesday, the President of the Federal Supreme Court, Jassem Muhammad Abboud, announced that the court has opened the horizons of communication with its counterparts from the courts in the Arab and international world.
The court stated in a statement received by Mawazine News, that “The President of the Federal Supreme Court, Jassem Muhammad Abboud, received today the Azerbaijani Ambassador to Baghdad, Naseer Mammadov, at the headquarters of the Federal Supreme Court in Baghdad, where the President of the Federal Supreme Court welcomed the Azerbaijani Ambassador to Baghdad, and during the meeting, the development of... Relations between the two friendly countries, enhancing joint cooperation in all fields, and the necessity of continuous communication and meetings to exchange legal expertise in the field of constitutional judiciary. Congratulations were sent to Judge Fikret Ighlu Mammadov for his appointment to the position of President of the Constitutional Court in Azerbaijan.”
The court added: “Through our serious efforts to make the constitutional judiciary a success, we look forward to strengthening the bonds of communication with the Constitutional Court in Azerbaijan because of its importance in supporting the democratic process to achieve the sovereignty of the law and the constitution,” noting that “the Federal Supreme Court in Baghdad has opened the horizons of communication with its counterparts.” In the Arab and international world and learn about the experiences of countries in this field to support the political and democratic process in Iraq.”
She explained that "the decisions issued by the Federal Supreme Court were discussed, especially the decision regarding the salaries of employees, retirees, and beneficiaries of the social protection network in the Kurdistan Region, and that the aforementioned decision included the obligation of the federal government to pay these salaries in accordance with the principle of equality for all members of the Iraqi people in accordance with what was stated in Article (14) of The Constitution of the Republic of Iraq for the year 2005, although the Federal Budget Law No. (13) for the years 2023, 2024, and 2025 obliges the regional government to implement what was stated in paragraphs (1, B, C, D) of Clause Two of Article (12) of the aforementioned law, and then The federal government decided to pay the region’s dues, but the Federal Court found that this dispute had a significant impact on the standard of living of the aforementioned segments in the region and deprived them of their rights. After the decision was issued, two salaries were delivered for two consecutive months.”
The President of the Federal Supreme Court pointed out that “the federal system in Iraq consists of a capital, regions, decentralized governorates, and local administrations based on the provisions of Article (116) of the Constitution, and that the Constitution approved, upon its implementation, the Kurdistan Region and its existing authorities as a federal region based on the provisions of Article (117) of the Constitution and its powers.” Regions have the right to exercise legislative, executive and judicial powers in accordance with the provisions of the Constitution, with the exception of what is stated therein regarding the exclusive powers of the federal authorities based on the provisions of Article (121/First) of the Constitution. The provinces that are not organized into a region enjoy broad administrative and financial powers that enable them to manage their affairs in accordance with the principle of decentralization. Administrative based on the provisions of Article (122/Second) of the Constitution.”
The Azerbaijani ambassador stressed that “his country looks forward to building strong relations with the Iraqi side at various levels, especially in the field of constitutional judiciary,” praising “the independence of the Iraqi judiciary and the role of the Federal Supreme Court in consolidating constitutional and democratic principles in a way that ensures the building of a parliamentary system based on the rule of law.” .
He also praised "the historical relations between the Iraqi and Azerbaijani peoples," stressing "work to create the atmosphere to develop relations between the two countries in the field of constitutional justice."
