    Independent MP Nazim Al-Shabli confirmed today, Monday, his rejection to vote on the Law Amending the Foundations of Certificates No. 20 of 2020.
    Al-Shabli told /Al-Maalouma/ Agency, "The amendment decision carries a lot of injustice and oppression for the segment of employed and non-employed students, as the law abolished Article 12, which allows studying during employment and from the leave balance and at his own expense without bearing any financial consequences for the state."
    He added, "Amending the law will make the period of residence continuous to 9 months, and this negatively affects applicants due to the difficulty of obtaining a continuous leave, knowing that the right to education is guaranteed legally and constitutionally." He pointed
    out that "Article 12 of the Law on the Foundations of Certificates allows the employee to study during the job with regular leaves from the accumulated balance or leave without pay," stressing that "giving a no-objection to study is the authority of the employee's ministry and not the authority of the Ministry of Education."
    Al-Shabli pointed out that "keeping the period of residence in the original law and not making it continuous, since most universities operate on a course system interspersed with a vacation."
    The 2020 law on the basis of equivalency of certificates allowed ministries to calculate all previous certificates that were issued before the date of the law’s approval and to equate them that were not previously counted, in addition to equating the initial certificates of all employees who obtained them without study leave over the past four years, which resulted in the calculation of hundreds of certificates.
    The Federal Supreme Court ruled that many articles of the old law were unconstitutional, including Article 12 of the law, which was described as “catastrophic” and stipulates that those assigned and employees of public service from directors, agents and general managers can study during employment or assignment now, which allowed “exploitation of the position and public service for the purposes of study and personal gain.” End/25Q
