    [size=45]Iraqi President Barham Salih called yesterday (Thursday) for the need to launch a "serious and urgent" dialogue between the federal government and the Kurdistan Regional Government, after the ruling issued by the Federal Supreme Court (the highest judicial authority in Iraq) last Tuesday that the oil and gas law of the regional government was unconstitutional. Saleh said in a statement yesterday (Thursday) that "the aim of this dialogue is to search for realistic mechanisms that guarantee what the Federal Supreme Court wanted to implement, and in a manner that guarantees the constitutional entitlements of the region and other Iraqis by harnessing imports to serve citizens away from corruption and mismanagement." He called on the House of Representatives to "immediate action to discuss the postponed oil and gas bill, by enriching its texts or presenting a new bill from the executive authority, and approving it without complacency."
    The Iraqi president considered that "the political forces' hesitation for years in approving the oil and gas law contributed to creating problems and crises, and brought us to this critical moment where we face its consequences today." He stressed "the necessity of forming the Federation Council, the missing legislative chamber in the existing political system, which Article 65 of the Constitution expressly and bindingly stipulates."
    The Iraqi president also called for “the necessity of establishing a public authority concerned with guaranteeing the rights of the regions and governorates stipulated in Article 105 of the constitution, and supporting the public authority to monitor the distribution of federal imports.” He also renewed his call to "amend the constitutional texts that have proven inapplicability or responsibility for entrenched crises, in addition to supplementing and amending the texts regulating the work and formation of the executive and legislative authorities."
    In this context, the Federal Supreme Court of Iraq issued a clarification regarding its decision following the uproar caused by the unexpected decision in terms of timing, in which it said: “There is a decision issued by one of the courts of the United States of America based on a lawsuit by the plaintiff from the Iraqi Ministry of Oil and the defendant, the Ministry of Natural Resources to the Kurdistan Regional Government,” indicating that that decision “was in the interest of the plaintiff and was appealed by the appellant, the Kurdistan Regional Government of Iraq. In Israel, the force of its argument on the subject of the appeal was weakened, and the decision ended with (for the aforementioned reasons, we agree to the ministry’s request (the Iraqi Ministry of Oil) to reject this appeal), and accordingly, the higher interest of Iraq and its people requires resolving the case numbered (59/federal/2012 and its unit 110/federal/ 2019) and issue a decision accordingly.
    The federal decision on the oil file was issued a few days after its ruling that the nomination of the leader of the Kurdistan Democratic Party, Hoshyar Zebari, for the post of President of the Republic was unconstitutional. While that decision was unexpected, the Presidency of Parliament was forced to reopen the nomination for the post of President of the Republic in order to allow the Kurdistan Democratic Party to nominate an alternative to Zebari. Indeed, the leader of the Kurdistan Democratic Party, Massoud Barzani, nominated the region's interior minister, Riber Barzani, for the post. However, since there is an appeal filed by Representative Basem Khashan against the parliament speaker's decision that the opening of the nomination is unconstitutional, the court is expected to issue a decision on this case next week. In the event that the Federation issues a decision unconstitutional to open the nomination door, the Kurdistan Democratic Party will lose the competition in favor of its rival, the Patriotic Union of Kurdistan, and its only candidate, the current president, Barham Salih.[/size]
