    Shafaq News/ The Board of Commissioners of the Independent High Electoral Commission responded. The Speaker of the Iraqi Council of Representatives, whose membership was terminated, Muhammad al-Halbousi, requested that his parliamentary seat be filled by a candidate from the list of the “Taqaddum” Party, which he heads.
    According to the decision issued by the General Secretariat of the Board of Commissioners on October 27, “his (i.e. Al-Halbousi) request that the alternative candidate be from his electoral list contradicts what was stated in Article (23) of Law No. (4) of 2023 (Amendment Law) The third is for the Law on Elections for the House of Representatives, Governorate Councils and Districts No. (12) of 2018), which stipulated that this law be implemented from the date of its approval in the House of Representatives on 3-26-2023.
    The decision explained, “(The law) does not apply retroactively to the House of Representatives elections that were held on 10/10/2021 and were approved by the Federal Supreme Court. Thus, both the winning candidate and the reserve candidate have an acquired right within the results of one electoral district in accordance with the legal rules that "It was valid at the time of the elections."

    The Presidency of the Iraqi Council of Representatives decided to officially terminate the membership of Council Speaker Muhammad al-Halbousi, based on the decision of the Federal Supreme Court, as of November 14, 2023.
    On Tuesday, November 14, the Federal Supreme Court, “the highest judicial authority in Iraq,” announced the termination of the membership of Parliament Speaker Muhammad al-Halbousi, against the backdrop of a lawsuit filed against him by Representative Laith al-Dulaimi, in which he accused him of forging his (Al-Dulaimi’s) resignation from membership in the House of Representatives. As a result, the Federal Court ruled to terminate their membership (Al-Halbousi and Al-Dulaimi).
