The Parliamentary Legal Committee warned of the consequences of amending Paragraph 12 of the Council’s bylaws, which relates to the election of the Speaker of Parliament, and adding a paragraph that gives the power to open the door for candidacy again and replace previous candidates, explaining that it will open the door for candidacy for the position indefinitely.
Committee member, Muhammad Jassim Al-Khafaji, said in an interview with the official newspaper, followed by Mawazine News, that “Parliament is moving towards amending Article 12 of the internal regulations, which relates to the election of the Speaker of the House of Representatives, as a paragraph will be added to it specifying the mechanism and method of election and the possibility of opening the door for candidacy once again.” Another, because it is not possible to open the door to running for office again without the amendment, so there is a tendency to add a paragraph in the bylaws from some political blocs and some political trends that allows for re-running again.”
He added, "The bylaws of Parliament are clear on the issue of closing the door to nominations in accordance with Article 12, which consists of three clauses, and the move towards adding a fourth paragraph related to how to open the door to candidacy and return it in the event that an absolute majority of candidates is not obtained," indicating that "the door to candidacy was opened in a session." Choosing the Speaker of Parliament, and no candidate won, and there is supposed to be another round, but the political agreement seeks to go to another round, with the door open for nominations and the replacement of previous candidates who did not obtain sufficient votes.”
Al-Khafaji stated that, from his point of view, “this issue is legally and technically incorrect, because as a result it will open the door to candidacy indefinitely, and here we will be faced with opening the door to repeated candidacy,” pointing out that “the matter is still a matter of controversy, and there is a lot of political will.” And diverse, and the position of Speaker of Parliament is not an easy position and differences exist.”
The committee member revealed that “a parliamentary committee was formed to look into this issue, and so far it has not achieved any meeting and there is a tendency to cancel it,” explaining that “if nominated names are presented by the concerned political parties or a request is made to proceed with holding a session, there will be no A problem, but there is a desire to replace the names after proceeding with amending the bylaws of the Council and not just Article 12 related to the position of presidency of the House of Representatives, as this bylaw contains several problems despite the amendment of some paragraphs at the beginning of the current parliamentary session and voting on them, including problems with the work of committees and other matters. Which needs to be drafted and amended, but if it is agreed to amend the bylaws, it may include Article 12.”
The political dispute revolves around amending the third paragraph of Article 12 in the internal regulations of the House of Representatives, which stipulates: “If the position of Speaker of the House or any of his two deputies becomes vacant for any reason, the House shall elect, by an absolute majority, a successor to him in the first session it holds to fill the vacancy in accordance with the controls of political balances between the blocs.” Some blocs propose adding a paragraph that would allow candidacy for the vacant position of Speaker of Parliament to be opened again following the dismissal of Muhammad al-Halbousi.
