The United Nations expressed its “concern” about a new law passed by the Iraqi parliament that criminalizes “homosexuality” and “changing a person’s biological sex,” and called for its abolition.
On April 27, the Iraqi Parliament voted on the proposal for the First Amendment Law to the Anti-Prostitution Law, which prohibited homosexuality in all its forms and its promotion, and also prohibited changing a person’s biological sex “based on desires, inclinations, and personality.”
Ravina Shamdasani, spokeswoman for the United Nations High Commissioner for Human Rights, said in a statement yesterday, Monday, that “this law contradicts many human rights treaties and agreements ratified by Iraq, especially the International Covenant on Civil and Political Rights, and must be repealed.”
The amendment abolished the name “Anti-Prostitution Law” stipulated in Law No. (8) of 1988, and replaced it with the “Anti-Prostitution and Homosexuality Law.”
The law defines prostitution as “the repeated practice of adultery with more than one person, with or without pay.”
As for “homosexuality,” it is “a sexual relationship between two people of the same sex, a male and a male, or a female and a female,” and “the exchange of wives for sexual purposes.”
It also prohibited “effeminacy,” which is “any intentional practice of imitating women, without taking into account what occurs for the purposes of representation.”
The law imposes a prison sentence ranging from 10 to 15 years for anyone who has a homosexual relationship.
It is also punishable by imprisonment for a period ranging from 7 to 10 years and a fine of not less than 10 million dinars and not more than 15 million dinars for anyone who “promotes prostitution or homosexuality by any means or assists in that in any way.”
