The Federal Court ruled that “phrases” contained in the electoral law were unconstitutional
Shafaq News/ The Federal Supreme Court of Iraq ruled, on Sunday, that a number of phrases of Article 46 of the General Parliamentary Elections Law approved by the previous parliament were unconstitutional.
And the Federal Court media said in a statement received by Shafaq News Agency, "The court decided, by its decision No. (144 / Federal / 2021) on 11/14/2021, that the phrase (otherwise, the alternative to it, who obtained the highest votes from the losing candidates from his list in his constituency, would be the one who won the most votes) was unconstitutional. Elections) and the phrase (individual candidate) from Article (46) of the Iraqi Parliament Elections Law No. (9) for the year 2020, due to their violation of the provisions of Articles (5, 14, 16 and 20) of the Constitution of the Republic of Iraq for the year 2005.
And she continued, "The article remains in the following form (the winning candidate in the parliamentary elections is obligated to take the constitutional oath within a maximum period of one month from the date of the first session, and in the event that the oath is not taken by the winner, the replacement for him will be the highest loser in his constituency."
