Today, Sunday, the Federal Court issued a decision regarding the acquisition of state-owned real estate.
In a statement received by Mawazine News, the court said:For the unlawful acquisition of state-owned real estate, taking advantage of the provisions of Article (24/third) of the Law No. (21/2013) of the Sale and Lease of State Funds, and in order to preserve the people’s money, the Federal Supreme Court decided by its decision No. (213/Federal/2021) on 9/ 2/2022, ruling unconstitutional and repealing Article (25/third) in the original law, which after the amendment became No. (24/Third) of the amended Law No. (21/2013) of Sale and Rent of State Funds, which stipulated (for the competent municipality after approval The Minister of Municipalities and Public Works and the Municipality of Baghdad may sell the lands allocated for housing at a real price and according to the prevailing prices for similar and neighboring ones estimated by the assessment committee stipulated in this law and without public auction to the Iraqis who do not own a house, an apartment or a residential land independently, and they, their spouses, or their minor children do not own a house, an apartment, or a residential land independently. They have obtained a housing unit or a residential plot of land from the state or housing cooperative societies).
And she added that "the first amendment No. (21) of 2016 regarding the law of selling and renting state funds No. (21) of 2013, Article (8) of it stipulated (the text of Article (24) of the law shall be deleted and the articles shall be re-arranged accordingly) on it became the above-mentioned text The person convicted of being unconstitutional within Article (24/Third) of the said law, and that the Federal Supreme Court decided to cancel it for violating the provisions of Articles (14, 16 and 27/first) of the Constitution of the Republic of Iraq for the year 2005.
