Kurdish politician Latif Al-Sheikh said today, Tuesday (October 31, 2023), that the Kurdistan region suffers from a supervisory vacuum with the absence of any legislative authority.
The sheikh stated in an interview with “Baghdad Today” that “in light of the dissolution of the regional parliament and the decision to dissolve the provincial councils, the situation of the Kurdistan region is now without any oversight of the legislative authority and it is completely absent.”
He added, "The current situation allows for an increase in corruption, theft, and illegal activities, due to the absence of supervisory authority."
The Sheikh pointed out that "the representatives of the Federal Parliament representing the governorates of the Kurdistan region can exercise the legislative role until the regional parliament elections are held next February."
On May 30, the Iraqi Supreme Federal Court issued a decision unconstitutional to extend the work of the Kurdistan Parliament for an additional year, after it renewed itself in the year 2022, considering that all decisions issued by it after that period are “invalid.”
Federal Court President Judge Jassem Muhammad said that the court ruled that the decision issued in 2022 to extend the work of the Kurdistan Parliament for a year was unconstitutional, and indicated that it undermines democracy in the country.
The president of the court added that all decisions issued by the regional parliament, as of the date of extending its term in October 2022, are considered null and void.
Last October, the regional parliament, consisting of 111 seats, extended the duration of its session for an additional year, postponing the elections that were supposed to be held in the same month, against the backdrop of political disputes between the two major parties, the Kurdistan Democratic Party and the Patriotic Union of Kurdistan, regarding how to divide electoral districts.
The two parties have pledged to hold elections in November 2023, but have not yet reached a consensus on the new regulations.
On May 22, representatives from both parties quarreled inside the regional parliament during discussions on electoral regulations, a sign that agreement is still a long way off.
Following the decision of the Federal Federal Court, the Kurdistan Democratic Party called in a statement on “all parties and citizens in Kurdistan to cooperate and facilitate the holding of fair elections” and “the government and relevant institutions to take the necessary steps.”
The Kurdistan Democratic Party has a majority in the regional parliament with 45 seats, followed by the Patriotic Union of Kurdistan with 21 seats.
The Kurdistan Democratic Party dominates, especially in Erbil, and holds the presidency of the region and the head of the government there. On the other hand, since the fall of Saddam Hussein in 2003, all the presidents of the Republic of Iraq have been from the Patriotic Union of Kurdistan.
Parliament plays an important role in the region, as it gives confidence to the government and its president and also approves local laws in the region, which also has its own security forces.
The regional parliament has extended its term more than once in recent years, against the backdrop of internal political rivalries that reached their peak in the 1990s, with internal fighting between the Barzani and Talabani families.
Kurdistan, which has enjoyed broad autonomy from Baghdad since the 1990s, has in the past ignored rulings issued by the Federal Supreme Court, including a ruling issued in February 2022 that the oil and gas law in the region was unconstitutional, according to Reuters.
More than 5 million people live in the Iraqi Kurdistan region, of which Erbil is the capital, out of Iraq's population of 43 million, and it produces about 450,000 barrels of oil per day, despite the cessation of exports in March.
