The Federal Supreme Court, on Wednesday, heard a lawsuit filed against the President of the Republic, the President of the Government and the Secretary-General of the Council of Ministers, and decided to return it for lack of jurisdiction to adjudicate administrative decisions.
Spokesman Iyas Al-Samouk said, "Mawazine News" received a copy of it, "The Supreme Federal Court held a session headed by Judge Medhat Al-Mahmoud and the presence of all the member judges. ".
Al-Samouk added, “The plaintiff requested the suspension and cancellation of the implementation of Resolution No. (445) for the year 2019 related to authorizing ministries and entities not affiliated with the Ministry and the governorates with direct contracting until 12/31/2019 as an exception to the instructions for implementing the federal budget for the fiscal year 2019.”
He stated that "the court held its session in the presence of the representatives of the parties to the case, and found that the decision that is the subject of the appeal is considered an administrative decision issued by the executive authority."
He stressed, "The court affirmed that it is not competent to consider the appeal submitted to the administrative decisions that the law has drawn as a way to challenge it, other than the path of appeal before the Federal Supreme Court, whose terms of reference are determined by what is drawn in Article (93) of the Constitution."
The Samuk went on to say that "the Federal Supreme Court, based on the foregoing, decided to dismiss the lawsuit because it was not based on a document of the constitution." Ended 29 / r
