    Baghdad/Al-Masala Al-Hadath: The Iraqi Federal Court’s ruling invalidating the demarcation of the maritime borders between Iraq and Kuwait, which was approved and ratified by the parliaments of the two countries years ago, raises a raging political controversy between the two countries. This controversy is linked to several sensitive issues:
    Bypassing the Kuwaiti Mubarak Port: Iraq accuses Kuwait of bypassing the Kuwaiti Mubarak Port at the entrances to the Iraqi Al-Faw Port to restrict it and force large ships not to enter it, which raises tension between the two countries.
    Disagreement over shared oil fields: Some shared oil fields are a source of contention between Iraq and Kuwait, reflecting regional competition over natural resources.
    Determining the baseline for border demarcation: The tripartite problem between Iraq, Kuwait, and Iran includes determining the baseline through which the borders of the territorial sea are demarcated, which is an issue that has not yet been decided and requires further negotiation and coordination.
    Kuwait's accusation against Iraqi political parties and groups: Kuwait considers the crisis of demarcating the maritime borders between Iraq and Kuwait to be a fabricated one, and accuses the political parties and groups in the Iraqi parliament of running the state and controlling decisions.
    These issues reflect the focal points of the political controversy between Iraq and Kuwait, and remain the focus of attention of the international community, which seeks to settle these disputes peacefully and in accordance with international laws and international maritime law.
    Tensions escalated between Kuwait and Iraq after the Iraqi Federal Supreme Court ruled that the Iraqi Parliament’s ratification of the agreement regulating navigation in the Khor Abdullah waterway between the two countries was unconstitutional last September.
    The Iraqi court says, in the merits of its ruling, that ratification of international treaties and agreements must be by law enacted by a two-thirds majority of the members of the House of Representatives.
    The State of Kuwait announced earlier its objection to the decision issued by the Iraqi Federal Court declaring the unconstitutionality of the law ratifying the agreement “regulating navigation in Khor Abdullah.”
