, the expert, Adnan Al-Sharifi, revealed the following steps for the state decision of the Federal Court to stop the work of the Presidency of the House of Representatives.
Al-Sharifi said, "The Federal Court had previously decided by its state decision No. 1 and 2 / federal / state order / 2022 on 13/1/2022 to temporarily suspend the work of the Presidency of the House of Representatives, and thus the commission refrains from practicing any of the functions of the presidency until the two lawsuits filed against its president are resolved." In addition to his job, claiming the unconstitutionality of his election and his two deputies, and it is obvious that the Federal Court either rejects the two invitations, and this is expected, and here and from the moment the decision is issued, the Presidency of Parliament resumes its duties.
He added, "The second decision is for the Federal Court to rule that her election is unconstitutional, and in the event that this happens, this decision will have the following effects:
1/ canceling the results of the election of Al-Halbousi as Speaker of the House of Representatives, and the same for his two deputies.
2/ The first session is considered continuing, and all decisions and measures taken in it after al-Mashhadani’s transfer to the hospital are considered as if they had not occurred.
3 / There is no need to re-swear the constitutional oath to the deputies.
4/ Re-complete the holding of the first session headed by the oldest member, Dr. Mahmoud Al-Mashhadani, who will invite the deputies to attend on a specific date to continue completing the requirements of the first session after the Federal Court’s decision that the election of the Speaker and his two deputies is unconstitutional.
5 / Completing the nomination procedures again for the position of Parliament Speaker and his two deputies and conducting a secret vote to elect them.
6/ The race is repeated among the winning blocs to submit names and signatures, and whoever gathered the most numerous bloc has to hand it over to the elected president of the council in the continuing session.
7 / Re-opening the door for nomination for the position of President of the Republic within thirty days from the date of the first session of the Council, according to the provisions of Article 72 / second / b of the constitution, and starting from the date of the end of the session after the veto.
