The Federal Supreme Court officially informed the Kurdistan Regional Government of terminating the work of the local government councils in Erbil, Sulaymaniyah, and Dohuk, at a time when it rejected a lawsuit regarding granting the governorates broad administrative and financial powers.
Erbil Governor Omid Khoshnaw said in a press conference during the opening of the Rashkin Street project yesterday, Tuesday, that “an official letter from the Federal Supreme Court arrived last Thursday in the Kurdistan region regarding this matter.”
He added, "The presidencies of local governments and provincial councils are awaiting instructions from the Kurdistan government on how to deal with the Federal Court's decision."
On the 24th of last September, the Federal Supreme Court (the highest judicial authority) issued a ruling terminating the work of the Kurdistan Region’s governorate councils due to the end of their electoral cycle. The court said in a statement that it decided to rule the unconstitutionality of Article (2) of Law No. (2) of 2019, the First Amendment Law to the Law of the Governorates of the Kurdistan Region of Iraq No. (3) of 2009, due to its violation of the provisions of Articles (2 / First / B and C) and ( 6) From the Constitution of the Republic of Iraq for the year 2005, pursuant to the ruling issued by No. (124/Federal/2023) on 9/24/2023.
On a parallel level, the Federal Court rejected the lawsuit filed by the Governor of Maysan regarding granting the governorates broad administrative and financial powers.
The court referred in a statement to “the legal principle of the Federal Supreme Court’s decision No. 87/Federal/2021.”
She explained that “the jurisdiction of the Federal Court contained in the amended Law of Governorates Not Organized in a Region No. 21 of 2008 is limited to what is stated in Article 31/XI/3 of the aforementioned law, and does not include obligating the Council of Ministers or ministries to transfer the powers stipulated in the same law.”
