The Federal Supreme Court announced, on Wednesday, that it had resolved all the cases submitted before it for the month of August, noting that it had resolved 9 cases this month, including stopping the implementation of one of the decisions of the Council of Ministers until the case is resolved.
According to a report by the official newspaper of the Supreme Judicial Council, "The constitution did not refer to the authority of the Council of Ministers to exercise any jurisdictional role in issues that came under the jurisdiction of the House of Representatives."
The report added, “The court considered that the appeal of the Council of Ministers because of the nomination of the President of the Iraqi University, without the parliament deciding the issue, is constitutionally invalid, noting that it rejected the lawsuit to cancel all amendments to the Law of Compensation for Those Affected by Terrorist Operations and Military Mistakes, arguing that Article 7 of the The Second Amendment Act has caused serious harm to a large number of injured, as it canceled the text that had established a pension for them and replaced it with an injury compensation.
And he continued: “It also postponed the appeal against the budget law for the year 2021 to early September, as the lawsuit included unconstitutionality and invalidation of some articles of Law No. 23 of 2021, specifically the phrase related to the establishment of the petrodollar fund in the oil-producing governorates, managed by the concerned governor and financed by increasing price differences. The proceeds from oil, as well as paragraph 58, which is related to obligating the Presidency of the Council of Ministers to send the names of those entrusted with the positions of heads of independent bodies, undersecretaries and advisors to the Council of Ministers on 30/6/2021.
