Earth News/ The legal expert, Ali Al-Tamimi, confirmed today, Saturday, that the Iraqi constitution requires the president of the republic to continue his work until a new president is elected.
Al-Tamimi told Earth News, "Article 72, Paragraph Two of the Constitution requires that the President of the Republic continue his work for 30 days until the election of the new President of the Republic."
He added that "this text, of course, restricts Article 75 related to the vacancy of the position and the assumption of the Speaker of Parliament in his place, because Article 75 of the Constitution required; First, the presence of the Vice-President of the Republic to be his replacement, and also Al-Halbousi was elected in this session and Barham Salih was elected in a previous session, if there is no coherence of a ruler of the constitution to replace him because Barham Salih is constitutionally temporary and has nothing to do with the current parliament or its oversight.
Al-Tamimi continued, "There is also a Federal Court decision, Resolution 51 of 2010. The Federal Court referendum was held in the same situation when it happened, and she said the President of the Republic will continue in his duties until the election of a new President of the Republic, if Salih proves that he will remain in office until a new President is elected."
