    Baghdad / Obelisk: The managing director of Sama Hammurabi Law Firm and Legal Consultations, lawyer Muhammad Majeed Al-Saadi, announced on Wednesday, November 23, 2022, that the Federal Court issued a decision obligating the Kurdistan Regional Government to implement the Federal Unified Retirement Law No. 9 of 2014.
    On Wednesday (October 23, 2022), the Federal Court held a session during which it discussed the lawsuit filed against the Kurdistan Regional Government regarding the retirement law followed in the Kurdistan Region.
    The Iraqi Federal Court decided the following:
    1- Compelling the defendant (Kurdistan Regional Government) to implement the Federal Unified Retirement Law No. 9 of 2014.
    2- Cancellation of work and the invalidity of work by Law No. 27 of 2006, which was canceled.
    The lawsuit bearing the number (212 / federal / 2022) was filed by a member of the Supreme Council of the Kurdistan Region Retirees Union, Ahmed Ali Sadiq, representing a group of retirees, against both the President of the Kurdistan Regional Government and the Minister of Finance and Economy of the Kurdistan Regional Government.
    In his lawsuit, the plaintiff requested that the court decide that the implementation of the Iraqi Retirement Law No. (27) of 2006 in the Kurdistan region is “unconstitutional” and oblige the two defendants to work under the Unified Retirement Law No. (9) of 2014 in force in Iraq.
    A member of the Supreme Council of the Kurdistan Region Retired Union, Ahmed Ali Sadiq, stated that he demanded in his lawsuit that “the Unified Iraqi Retirement Law No. (9) of 2014 be implemented in the Kurdistan Region, and not by Law No. (27) of 2006 in force in the Kurdistan Region, which was abolished.” Working with it in Iraq, where the retirees in Iraq enjoy many privileges, while the retirees of the Kurdistan region are deprived of those privileges.
    Ahmed Ali Sadiq explained that there are about 250,000 retirees in the Kurdistan region, “and while the lowest retirement salary in Iraq is 500,000 dinars, the minimum pension in the Kurdistan Region is 200,000 dinars, and 100% of the nominal salary is dealt with while Our dealings (in the Kurdistan Region) account for 80% of it, in addition to many other things.
    Among the rights enjoyed by the retiree, according to the Unified Iraqi Retirement Law No. (9) of 2014:
    The minimum retirement salary for the retiree is (400,000) dinars (four hundred thousand dinars) per month.
    The pensioner for his services shall be granted living improvement allowances, so that the sum of his retirement salary and allowances (certificate, life improvement) shall not be less than (500,000) dinars (five hundred thousand dinars) per month.
    An end-of-service gratuity is paid to the person who is retired and has service of no less than (25) twenty-five years, and it is calculated on the basis of the full last salary and allowances multiplied by (12).
