Legal expert Tareq Harb ruled out declaring a state of emergency in [You must be registered and logged in to see this link.] because members of Parliament enjoy a legislative holiday, indicating that Parliament Speaker Muhammad al-Halbousi does not have the authority to declare without the vote of members of the Council.
Harb said that if Parliament declares a state of emergency without holding any session of the House of Representatives, Muhammad Al-Halbousi will violate the constitution, noting that the constitution required members of Parliament to vote by majority to declare any emergency in the country.
He cautioned that the Speaker of the House of Representatives or his two deputies, whether they are together or alone, have no authority to declare a state of emergency in Iraq.
The office of the President of the Republic had announced that President Barham Salih had sent a message with the resigned Prime Minister Adel Abdul Mahdi to Parliament Speaker Muhammad al-Halbousi to declare a state of emergency for thirty days in Iraq.
