The judiciary postpones the suit of the Integrity Commission against the Speaker of Parliament

     Baghdad / Range

The Federal Court postponed yesterday a hearing on the case filed by the head of the Integrity Commission Hassan al-Yasiri, asking to rule on the unconstitutionality of appointing a prosecutor at the ministerial centers.
"The hearing witnessed a case set up by the head of the Integrity Commission Hassan al-Yasiri, in addition to his job on the Speaker of the House of Representatives, in addition to his job, the request to rule on the unconstitutionality of the text of the articles (XII, III) Article (5) of the Public Prosecution Law No. (49) for the year 2017 concerning the appointment of a prosecutor in the ministerial centers for violating Article 102 of the Constitution.
Article (12) of Article (5) stipulates that the investigation of financial and administrative corruption crimes and all crimes against the duties of public office stipulated in the Penal Code No. (111) of 1969 (amended) in accordance with the provisions of the Criminal Procedure Law No. 23 of 1971, Provided that the case is referred within 24 hours from the date of the arrest of the accused to the investigating judge.
Article (13): A department shall be established in the Presidency of the Public Prosecution, called the Administrative, Financial and Public Prosecutors Affairs Department, to be managed by a public prosecutor of no less than 15 years' service, who shall supervise the financial and administrative public prosecution offices in the State Departments.
Article XIV / Article 5 stipulates that the Office of Public and Administrative Prosecution shall be established in the ministries and independent bodies exercising its jurisdiction in accordance with the provisions of paragraph 11 of this Article.
The spokesman of the Federal Court that "Yasiri claimed that the article contested unconstitutional obstructs the investigation of cases of financial and administrative corruption, which is carried out by the body as that jurisdiction concerns the Integrity Commission and not the members of the public prosecution, and has introduced the Chief Prosecutor, a third person in the case to stand From what is necessary to resolve them. "
Samok confirmed that "the Federal Court decided to postpone the hearing of the case until 22 January next hearing the words of the chief prosecutor."
Moreover, the Federal Court said that it "postponed in its hearing held the case of Mohammed Mashi al-Tai, including the appeal of the decision of the House of Representatives to cancel its membership to the next 22 of January."
"The Ministry of Foreign Affairs will be approached to know the position of the legal prosecutor against the charges against him from the authorities in the UAE."
It is noteworthy that the House of Representatives voted, on 25 May last, to remove MP Mohammed al-Tai to exceed his absence limit allowed.
Al-Taie was arrested in the United Arab Emirates in cases involving money and the granting of instruments without credit to a person. Al-Taie holds Swedish citizenship, which has restricted Iraqi foreign efforts to defend him.
In the same context, the Federal Court overturned an invitation by the Minister of Finance to challenge some paragraphs of the institution of prisoners.
