The Independent High Electoral Commission issued, on Monday, special instructions for filing a complaint and contesting the ballot.
The spokesperson for the commission, Jumana Al-Ghalay, said in a press statement distributed to the media, including (Mawazine News), that "the complaints of public and private voting amounted to 74 complaints," noting that "the voter, the candidate and the party or coalition agent are the ones who have the right to file a complaint in The National Office or the Kurdistan Region Election Commission or the electoral office in the province and the registration and polling center.”
She explained, "Complaints of the general vote end at the end of the official working day for this day," noting that "the stages of the complaint are receipt, registration and sending, and they are transferred from the governorate office within 24 hours to the national office."
And she pointed out, that "the investigations and recommendations are 4 teams, for each team, a group of investigators undertakes the investigation and raises recommendations, and the decision is made by the Board of Commissioners exclusively and published within 3 days of the issuance of the decision and in the way that the Board deems appropriate and in the Arab and Kurdish ways," stressing that "the appeal is before the commission." The judicial process shall be within 3 days starting from the day following the publication.
And she continued, "The Council of Commissioners is the exclusive authority to consider complaints arising from the preparation and implementation of campaigns. The Complaints and Appeals Department is the specialist according to the complaints and submits recommendations in this regard to the Council of Commissioners, and the complaint committees in the electoral district offices are linked to it."
And she pointed out that “one of the conditions for complaints is that they be in writing and signed by the applicant, and that they include data, including the participant’s name, signature, address and the necessary information, and that the complainant is one who witnessed the incident and is supported by the station director and polling center coordinator on the origin of the complaint, and that the Council has discretion in the event The complaint was received without the support of the station manager or coordinator."
And she added, "Among the conditions is that the name and information of the complainant, if any, and a detailed description of the supposed violation with mentioning the date, time, place and circumstances surrounding the incident and the names of witnesses, if they were present, and any documents or evidence of the occurrence of the accident to support the complaint," stressing the "coordinating station manager."
