Observers and specialists in political affairs saw that the issue of resolving the vacant position of “Speaker of Parliament” must be in accordance with the law and political entitlements, indicating that the latest political developments indicate that the selection of the Speaker of the House of Representatives will take place after the end of the blessed month of Ramadan, and that the Council will remain headed by Acting Speaker of the Council, Mohsen Al-Mandalawi, according to Federal Court Decision No. 322. Political affairs analyst, Dr. Saif Al-Saadi, said in an interview with “Al-Sabah”: “The issue of choosing the Speaker of the House of Representatives has not yet been decided, and according to sources close to the political scene, this position “It will not be decided until after the holy month of Ramadan.” He pointed out that, “According to the data and the political scene, the House of Representatives will remain under the acting presidency of Mohsen Al-Mandalawi, because the Federal Court’s explanatory decision No. 322 gave a clear permit to the First Deputy to manage the sessions, provided that the election of a new president is considered a disruption of constitutional entitlements.” He added, “Therefore, there is no There are concrete solutions on the horizon in light of the non-implementation of many demands, including the Oil and Gas Law, the Federal Court Law, and the Union Law, in addition to the fact that the remaining life of the Sudanese government is approximately a little over a year, considering that we are talking about parliamentary elections that will be held next year, 2025, and there is no time left for such legislation. For his part, the advisor to the Iraqi Center for Media Studies and Development, Dr. Ali Fadlallah, said in an interview with Al-Sabah: “The position of Speaker of the House of Representatives is an important and sovereign position, and according to the prevailing political custom since 2003, the position of Speaker of Parliament goes to the Sunni political component.” However, the problem in this aspect is complex, including that the division of the political component that has the right to this position will make the political scene complicated in light of the presence of problems regarding the candidate for the head of the (Taqadum) party, who is supposed to have a decision by the Federal Court regarding the validity of his membership, and this The issue will make the matter critical, so going to the issue of pushing to change the bylaws of Parliament is intended to be able to replace Al-Halbousi’s candidate with a new candidate in order to win this position.”
Fadlallah pointed out, “This matter will complicate the selection of the presidency of this position in addition to the complexity of the political scene due to its great importance - even if it is occupied by Dr. Mohsen Al-Mandulai on an acting basis - but in order to maintain balance and benefits, this matter must be resolved by the Sunni political component.” Pointing out, “If there is a change to the internal system, we will witness a change in the selection map for names for the next stage, and we will need time, and this may negatively affect the stability of the political process.”
The House of Representatives is expected to vote on amending and adding a paragraph to Article 12 of the House’s bylaws during the coming sessions, which allows for the introduction of a new candidate to fill the position of Speaker of the House of Representatives. Last December, the Federal Supreme Court issued its interpretive decision No. (322/Federal/2023), which relates to the interpretation of Article (55) of the Constitution of the Republic of Iraq for the year 2005, which stipulates that (the House of Representatives shall elect in its first session a president, then a first deputy.
