members of the Supreme Judicial Council meet tomorrow, Monday, to implement the law to amend the Federal Court Law, which the House of Representatives voted yesterday, while the legal experts see the amendment much better than the law that was put to the vote for the first time, while they confirmed that there is no objection to dissolving Parliament after Adoption of the budget.
Member of Parliament, Wafaa Al-Shammari, believed that the House of Representatives vote on the first amendment to Federal Court Law No. 30 of 2005 placed the third and last pillar of early elections.
Al-Shammari said, in a press statement: "The House of Representatives, after completing the voting on the election laws and the Election Commission earlier, was able, in Thursday's session, to complete the third and important pillar of the early elections that the reference and the masses demanded."
He explained, "The parliament was able to overcome all challenges and complete what it is in this vital and important file, as the ball is today in the court of the government and the Elections Commission to complete their duties and prepare the appropriate ground for early elections."
She added, "Parliament today faces a new challenge related to the citizen’s sustenance, which is the completion of the Federal Budget Law, which we hope will be resolved and voted upon, to be a new victory in addition to the legislative authority’s efforts to meet the demands of the Iraqi people."
For his part, legal expert Tareq Harb said, "Parliament voted to amend the law that was passed when Iyad Allawi was prime minister, No. 30, and which is still in effect, as the amendment included referring the existing to retirement and appointing 9 judges instead of them."
He added, "To speed up the resolution of the law and for the Judicial Council to meet to select judges because of the proximity of the elections that must be held in October of this year."
Harb revealed that there is no "obstacle to dissolving parliament after approving the current year budget."
For his part, the legal expert, Ahmed Al-Abadi, said in a press statement that "the constitution stipulates that those who administer the court and issue its decisions are judges only, based on Article 88, which affirms that judges are independent, and there is no authority over them in their rulings except for the law, and no authority may interfere in The judiciary or in matters of justice. "
"The Federal Court would have become a subject of conflict if the clergy and jurists were among its members because of the different provisions and legislation between one sect and another, and this would lead to the disruption of many laws and legislations," Al-Abadi said.
The legal expert indicated that there is one negative point included in the legislation, "through a text in the amendment of Federal Court Law No. 30 of 2005, which refers to preserving the constitutional balance in the Federal Court, which is intended here as a sectarian balance."
