, the head of the Babylon Federal Appeal Court, Judge Basem Abdul Zaid Al-Ardi, confirmed on Tuesday that the courts issue daily rulings, but are not responsible for their implementation.
His speech came during a workshop organized by the court and attended by a group of media professionals, jurists, opinion leaders, representatives of unions of teachers, engineers and civil society organizations. It was chaired by Judge Basem Al-Ardi, in the presence of the Public Prosecutor in Babel Hussein Shaker, and Judge Ahmed Al-Amidi, who specializes in looking into integrity issues in Babylon.
Judge Basem Al-Ardi said, according to a statement of the Supreme Judicial Council, a copy of which was received by Mawazine News, that "the workshop we are holding today comes based on the directives of the President of the Supreme Judicial Council, Judge Faiq Zaidan, to spread the legal culture and clarify the constitutional and legal role of the judiciary."
He pointed to "the importance of the role of the media and educated elites in communicating information and spreading legal awareness, especially with regard to judicial work and the roles played by the judiciary in combating crimes, and its decree in accordance with the laws and legislation in force."
The head of the appeal spoke about “the importance of the independence of the judiciary and non-interference in its work,” noting that “the people are the source of the authorities and are the watchers of their work, but this oversight must be exercised with respect and confidence, not to reach the infringement that ultimately leads us to ominous stages. He stressed that "any disruption or suspension of the work of the judiciary brings us into the law of the jungle."
Al-Ardi continued, "The courts issue daily rulings, and they are not responsible for their implementation because implementation is the responsibility of other institutions, so the judiciary cannot be held responsible for the failure of the rest of the authorities and the negatives of the policy."
He stressed, "The doors of the judiciary are open to all, especially peaceful demonstrators, in accordance with the standards of trust and mutual respect, and in a manner that does not result in interference with the work of the judiciary, its independence and impartiality, and does not generate pressure that causes embarrassment."
He added, "Directing pressure should push towards providing a safe environment for the judiciary to operate independently and transparently, and stresses the principle of separation of powers, which is a constitutional principle, which is confirmed by the President of the Supreme Judicial Council, but so far the highest judicial positions are still subject to the approval of the House of Representatives." This constitutes a judicial challenge and a constitutional gap that everyone must work to correct."
The Appeals President listened to "a number of interventions and questions and answered them clearly and transparently," noting that "the judiciary is open to the media to elicit information from its official and confirmed sources."
For his part, Judge Ahmed Al-Amidi stressed "the role of neutral and objective media in consolidating the principle of judicial independence and consolidating judicial principles through the dissemination of information, taking into account professionalism and complete impartiality, and spreading a culture of respect for the judiciary and non-interference in the work of judges."
