The United Nations Mission in Iraq issued a detailed report on "violations" that documented the trials of opponents and demonstrators in the Kurdistan region.
The report, which was reviewed by NRT Arabia (December 22, 2021), came to conclusions, after observing 4 cases in which people were “known for their public criticism of the authorities.” and impartial.”
The report pointed out that court judges "eliminated statements submitted by 8 of the defendants about their confessions being extracted under torture, without further scrutiny of these statements."
He also indicated that "some judicial rulings used by the authorities in the region were based on Article 222 of the Penal Code approved by the previous regime and were suspended by the Coalition Provisional Authority in Order No. 19 of July 9, 2003."
The report also touched on "other violations", including relying on secret informants without questioning them publicly, issuing sentences without clear evidence based on vague rulings, and without allowing lawyers to meet with the accused before trial procedures.
The United Nations team concluded the report with eight recommendations, including; Ensure that any accused person has fair trial rights and procedural safeguards, and that detention safeguards are fully implemented, including prompt and effective investigations into all allegations of torture and ill-treatment.
The recommendations also stipulated, "to ensure judicial procedures without undue interference, including political interference, and to amend existing laws to provide clear definitions of prohibited behaviour."
