The law includes 20 different articles. The law guarantees the opening of centers and offices for the “Legal Aid Council” in the governorates. The law guarantees the provision of legal services, handling of lawsuits, and taking rights in the courts and all government departments for a number of categories “free of charge.”
The law stipulates that the categories covered by these services are: “victims of domestic violence, those covered by social protection, residents of state shelters, the displaced and displaced, the husband of the martyr and his minor children, his student sons, or his unmarried daughters.” These five categories are delegated without verifying whether they are Financially able or unable.
In addition, there are 6 other categories included if they do not have the financial capacity, which are: “victims of sexual crimes, victims of human trafficking, children at risk, refugees, people with disabilities and special needs, and people with disabilities as a result of military operations and terrorist acts.”
The law includes contracting with lawyers and determining their fees, which are paid by the council formed by this law. In return, the council and the lawyers’ fees are funded from the state treasury or gifts and donations, as well as money or fees obtained from the opponent in lawsuits for victims and citizens.
The law includes stopping legal aid and taking care of lawsuits if it is discovered that the plaintiff or agent possesses funds and can appoint a lawyer at his personal expense without the need to resort to the free legal aid center.
According to the Bar Association, the law guarantees that lawyers combine two jobs, that is, that they contract with legal centers to act on behalf of the included persons and citizens and take their money from the Legal Aid Center. At the same time, they also have the right to assign other cases in their private work.
The law guarantees that the Center will refrain from paying the lawyer’s fees if he fails in the case in bad faith or incompetently.
