The Iraqi Prime Minister and Commander-in-Chief of the Armed Forces, Mustafa Al-Kazemi, assigned the Ministry of Oil to coordinate with the Kurdistan Regional Government to develop a mechanism that would manage the oil file, following the decision of the Federal Court issued in this regard.
This came during Al-Kazemi chairing, yesterday, Wednesday, a meeting of the Ministerial Council for National Security, during which he discussed the latest developments in the security situation and developments in the country and the regional arena.
According to a statement issued by Al-Kazemi's media office, the council hosted the Minister of Oil to discuss the recent Federal Court decision on oil management in the Kurdistan region, in addition to a number of issues on the agenda. Yesterday, Tuesday, the Federal Court issued a decision stating that the oil and gas law in the Kurdistan region is unconstitutional. In its decision, the court obligated the Kurdistan Regional Government to enable the Ministry of Oil and the Federal Office of Financial Supervision to follow up on the conclusion of contracts for the sale of oil and gas in the Kurdistan region. The Ministerial Council for National Security decided to assign the Ministry of Oil to communicate and coordinate with the Kurdistan Regional Government and the companies and countries concerned, to prepare mechanisms and steps to manage this file in accordance with the provisions of the constitution and the supreme national interest.
The Council also authorized the Ministry of Oil to seek the assistance of consultants and experts from inside and outside Iraq in order to develop a technical and temporal road map in this regard, according to a statement by Al-Kazemi's media office.
For its part, the Kurdistan Regional Government confirmed that the Federal Supreme Court's decision on oil and gas is based on the laws of the Baath, indicating that it violates the law and judicial procedures. A statement issued by the Kurdistan Regional Government stated that the Federal Supreme Court “decided without considering constitutional principles,” adding that the Federal Court’s decision “is based on the laws of the former Baathist regime.”
The Kurdistan Regional Government considered that the decision of the Federal Supreme Court “contradicts the principles of federalism,” noting that “it is the duty of the federal authorities to repeal laws issued after 2005.”
The Federal Court's decision promised that it "includes several legal violations and judicial procedures," adding that "this unjust and unconstitutional decision contradicts the constitutional rights and authorities of the Kurdistan Region and is unacceptable. The court should have expanded its investigations and considered the demands of the Kurdistan Region."
According to the Kurdistan Regional Government's statement, it "will take all constitutional, legal and judicial measures to secure and protect all oil and gas contracts."
She stressed that "we will not give up the rights of the Kurdistan region, which are entrusted to the Iraqi constitution, and in this regard, the Kurdistan Regional Government will continue its efforts with the federal government to reach a basic constitutional solution to this issue, despite the request and efforts of the Kurdistan Regional Government to postpone this request and give the Kurdistan Regional Government a chance." agreement with the next federal government. And before that, President Masoud Barzani stressed that the decision of the Federal Supreme Court is political and contrary to the constitution of Iraq, declaring that the Kurdistan region will defend its constitutional rights with all its might. A statement issued by President Barzani announced to the Iraqi and Kurdish public opinion, that the decision of the Federal Supreme Court on the oil and gas of the Kurdistan region is “a purely political decision, contrary to the Iraqi federal constitution and its aim is to antagonize the Kurdistan region and the federal system in Iraq.”
"We hope that the governments of Iraq and the Kurdistan region will be able to overcome the obstacles and agree on the oil and gas file," President Barzani said, declaring to "everyone that the Kurdistan region will defend with all its might its constitutional rights."
It is noteworthy that the Federal Supreme Court issued a ruling that the oil and gas law in the Kurdistan region is unconstitutional. And the government, in its decision (on Tuesday, February 15, 2022), committed the Kurdistan Regional Government to enable the Ministry of Oil and the Federal Office of Financial Supervision to follow up on the conclusion of contracts for the sale of oil and gas in the Kurdistan region.
