The Danish Supreme Court has annulled a judicial decision obligating Copenhagen to pay compensation to 18 Iraqis who were tortured during a joint operation by Iraqi forces and Danish soldiers, during the Iraq war.
In 2018, an appeals court ruled that the Danish state should pay compensation to 18 people out of 23 Iraqis who sought refuge in the Danish judiciary after they were arrested and subjected to “torture and inhuman treatment” during the “Green Desert” operation in the Iraqi Al-Zubair region, 10 km from Basra Governorate in 2004.
The Court of Appeal held that the Danish soldiers "failed to prevent torture, even if they did not participate in it."
The court estimated that the Danish forces were aware that the prisoners were exposed to "real threats" of torture by Iraqi forces, and ordered the Danish state to pay compensation of 30,000 kroner (about $4,300) to each.
However, the Supreme Court overturned the ruling and ruled that the Ministry of Defense was not obligated to pay compensation, as it considered that the Danish forces "were not involved in, and were not aware of, torture."
The court said in a statement: "The Danish forces had no concrete reasons to believe that Iraqis would be subjected to torture." Ended 29 / h
