The Supreme Judicial Council clarified, on Wednesday, the fact that a judicial decision was issued regarding the election results, speaking of a procedural error.
The Supreme Judicial Council clarified, on Wednesday, the fact that a judicial decision was issued regarding the election results, speaking of a procedural error.
The council said, in a statement reported by the official agency, and followed by "Mawazine News", that "the mechanism by which the Judicial Council deals with appeals against election results is carried out in accordance with the law by submitting a request by the objector to the results to the Board of Commissioners, including objecting to the results and requesting a retrial. Counting its votes or any other request,” noting that “the Board of Commissioners scrutinizes the request according to the evidence presented, and either it issues a positive decision to respond to the request, or it issues a negative decision rejecting the request.”
He added that "the objector has the right to appeal the negative decision of the Board of Commissioners before the Judicial Authority for Elections affiliated to the Supreme Judicial Council, which either supports the decision of the Board of Commissioners or revokes it," noting that "part of the appeals were submitted to the judicial body directly and this is a procedural error, as it is supposed to be submitted to the Board of Commissioners, which issues a specific decision and then appeals against this decision.
The council added, "The appeals submitted were returned by a letter to the Board of Commissioners to issue a decision on them, and then returned again to the judicial authority for consideration in accordance with the law," pointing out that "there has not been any decision by the electoral judiciary regarding the results of these elections so far."
Regarding the conditions and possibility of resorting to manual counting, the Council affirmed that “the Board of Commissioners can approve the manual counting in the event of an appeal at specific stations, if there is evidence that requires manual counting,” noting that “in the event the Board of Commissioners rejects this, the Judicial Commission for Elections can decide That and here we mean the manual counting (for the contested stations only, not the comprehensive manual counting of all stations).” Ended 29/A 43
