    The legal expert Ali Al-Tamimi confirmed, on Sunday, that any appointment made by an executive or legislative body to the special grades covered by the obligation of Parliament to vote outside the scope of the constitutional articles is considered null and the new government should cancel the appointments by the same method of appointment.
    Al-Tamimi said in a statement to / the information /, that “the appointments of the special degree are bound by constitutional articles (61) fifth paragraph and (80) fifth paragraph, where a proposal must be submitted by the Council of Ministers to Parliament for a vote on it, and since Al-Kazemi’s government is a caretaker government that is not constitutionally allowed to send A proposal for appointment to special degrees.
    He added, “Any appointment made by any executive or legislative body to the special grades included in the obligation to vote Parliament outside the scope of the constitutional articles is considered null and the new government must cancel appointments by the same method of appointment as the caretaker government. The new government must cancel these appointments by the same method of appointment, and for those affected by Cancellation: resorting to the administrative judiciary and challenging the decisions of the caretaker government.”
    Al-Tamimi explained, “The person affected by the cancellation has the right to resort to the administrative judiciary and to challenge the decisions of the caretaker government or Parliament.”
    He stressed that “there is no legal text that allows proxy appointments, and Parliament can legislate a special law for this that shows us the duration of the appointment by proxy, as if it was a month, and also determines what these special degrees are, and it can have the final say in this matter.” finished / 25 AD
