A legal expert confirmed that the resigned Prime Minister, Adel Abdul Mahdi, could not abandon his duties or authorize one of his deputies to run the government.
Legal expert Ali al-Tamimi said in a press statement: "The absence of Abdul-Mahdi and the abdication of office violates [url=https://www.thebaghdadpost.com/ar/Story/t/2867/%D8%A7%D9%84%D8%AF%D8%B3%D8%AA%D9%88%D8%B1 %D8%A7%D9%84%D8%B9%D8%B1%D8%A7%D9%82%D9%8A]the Iraqi constitution[/url] , as it cannot be superior to the internal system over the constitution according to a rule (does not contradict the lower minimum law)," noting that "this absence violates the internal system." The Council of Ministers for the year 2019, which required the continuation of the Council of Ministers to act as a caretaker until the formation of a new government, and the resigned prime minister cannot abandon his duties.
He added: "Abdul-Mahdi cannot assign someone to head the council because this is not his authority according to the concept of conducting business, and this situation is permissible only in limited cases such as sickness and travel ... He is also resigned and his authority is not mandated to designate a representative for him because that is outside the concept of conducting business." .
