    A number of women and activists organized vigils in several governorates, including Basra and Maysan, against the amendment of paragraph 57 of the Personal Status Law.
    The Personal Status Law of 1959 grants the right of custody to the mother by referring to the first paragraph of Article 57, which states that “the mother has the right to custody and education of the child.” Three amendments were made to the aforementioned article in the 1970s and 1980s by the dissolved revolution leadership by doubling the mother’s age from 7 years to 10 years, which can be extended to 15 years. According to the article, custody of the child remains for the mother even if she remarries.

    About two years ago, the Supreme Judicial Council [You must be registered and logged in to see this link.] a judicial committee to prepare a draft amendment to Article 57 after discussing several points, including an increase in the divorce rate. The committee was tasked with “reviewing the legislation in force to prepare a draft amendment to some articles of the Personal Status Law, including Article 57 related to custody, in order to reach Legal remedies to preserve family unity and avoid cases of divorce, family disintegration and the resulting negative social phenomena.
