    The former Minister of Transport, Amer Abdul-Jabbar, revealed today, Sunday (September 10, 2023), that the Khor Abdullah Agreement between Iraq and Kuwait has become “annulled” after the Federal Supreme Court’s decision to veto the agreement and consider it a violation of the Constitution.
    Abdul-Jabbar told "Baghdad Today", "Kuwait deposited a copy of the agreement signed between the two countries in 2013 with the United Nations, and what was recently issued by the Federal Court is that Parliament's ratification of that agreement was in violation of the constitution."
    He added, "If the Iraqi parliament had enacted a new law canceling the agreement, the Kuwaiti side could have protested and not accepted the matter, but because the veto came through the Federal Court, which is the highest judicial authority in Iraq, the United Nations respects the judiciary."
    He pointed out to Abdul-Jabbar, “The judiciary demolished the parliament’s ratification, and therefore Kuwait cannot protest that the agreement cannot be amended except with the approval of both parties, and this matter came after the approval of the parliament at the time, since Kuwait deposited the agreement after the Iraqi parliament’s ratification.”
    He stated that "the ratification of the agreement has become null and void, since the judiciary demolished that ratification and considered it a violation of the constitution, and therefore requires the Ministry of Foreign Affairs to file the decision of the Federal Court and deposit it with the United Nations, in order for this agreement to be officially cancelled."
    He stressed, "Renegotiating again in a way that guarantees the rights of the two countries, and the government must take a lesson from the Federal Court and its recent decision that the agreement was humiliating for Iraq."
    It is noteworthy that the Federal Supreme Court in Iraq ruled, on September 5th, to invalidate the “Khor Abdullah Agreement” regarding the regulation of maritime navigation in the waters of the Gulf between Iraq and Kuwait, amid fears of the impact of this decision on Iraqi-Kuwaiti relations.
    The decision, which implicitly means an Iraqi withdrawal from the maritime border demarcation agreement with Kuwait, prevents the Iraqi government and parliament from relying on the agreement signed in 2013 in any action taken by Baghdad with the State of Kuwait.
    The "Khor Abdullah Agreement", which regulates maritime navigation in Khor Abdullah in the Gulf between Iraq and Kuwait, and was ratified in 2013, during the government of Nouri al-Maliki, is considered one of the most prominent files related to the issue of demarcating the land and water borders between the two countries.
    The decision sparked resentment from members of the Kuwaiti National Assembly (Parliament), and some of them demanded that the file of compensation for Iraq be opened.
    Khor Abdullah is located in the north of the Gulf, between the Kuwaiti Bubiyan Island and the Iraqi Al-Faw Peninsula, and extends into Iraqi territory, forming Khor Al-Zubair, in which the Iraqi port of Umm Qasr is located.
