The Parliamentary Narcotics and Psychotropic Substances Control Committee discussed a legislative report regarding proposals to amend Drug Law No. 50 of 2017, in which it addressed four axes: therapeutic, preventive, punitive, and administrative reforms.
The committee's legal advisor, Dr. Bashar Al-Hattab, told Al-Sabah: The proposals focused on four basic aspects, the first of which is the therapeutic aspect, indicating that there is a possibility of reviewing private clinics for the purpose of receiving treatment and health and psychological care by adding (the private outpatient clinic) to the definition of the clinic contained. He pointed out the establishment of social rehabilitation centers in all governorates for the purpose of receiving treatment and training in rehabilitation and integration programmes, in addition to amending Clause (First) of Article (40) of the law to replace it: That criminal proceedings shall not be brought against any who come forward who are users and addicts of narcotic substances or influences. Al-Hattab added that the second axis discussed preventive aspects, as there is a need to activate the principle (prevention is better than cure). To translate this principle, we found a need to consolidate the intellectual and educational aspect to address the phenomenon of abuse and trafficking in drugs and psychotropic substances through (school curricula, media, civil society, primary examination). Regarding the third axis, Al-Hattab explained that he focused on the punitive aspects, indicating that the committee noted the increase in drug crimes of all kinds (trade, promotion, and abuse) annually and the inadequacy of the current legal deterrent.
He continued that when comparing the number of people convicted of drug crimes for the first half of the current year with the total number of people convicted of all crimes until the end of the year 2022, we find that drug crimes constituted a percentage of approximately 20%, proposing to amend Article (29) so that the punishment shall be for a period of no less than one year and no more than ( 3) Three years.
He pointed out that the fourth axis on administrative reforms aims to raise the level of authority of the authority responsible for drawing up a policy for the import and export of narcotic drugs and psychotropic substances and the authority responsible for developing a comprehensive strategic plan to combat drugs in Iraq.
