    On Thursday, the Federal Supreme Court interpreted the constitutional article regarding the election of the Speaker of the House of Representatives.
    The court stated in a statement that it “issued its interpretive decision No. (322/Federal/2023) on Thursday, 12/14/2023, which relates to the interpretation of Article (55) of the Constitution of the Republic of Iraq for the year 2005, which stipulates that (the House of Representatives shall be elected in the first session It has a president, then a first vice president and a second vice president, by an absolute majority of the number of council members, by direct secret election.”
    She added, “The interpretation of the aforementioned article according to the court’s interpretive decision makes it clear that:
    The statement went on to state that “the vacancy of the position of Speaker of the House of Representatives is addressed by the provisions of Article (12/Third) of the internal regulations of the House of Representatives, and that this requires the House of Representatives to convene for the purpose of opening the door for nominations for the presidency of the House of Representatives to any of its members who wish, and that the opening of the door for nominations be limited to that session only.” In order to resolve the issue of electing the President of the Council in a timely manner and not to prolong it, no new nomination may be accepted after the beginning of the voting procedures.”
    The statement stated that “the election of the President of the Council takes place by an absolute majority in that session or in the following sessions after the first session (from among all candidates in the first session - except for those who request to withdraw from candidacy).”[/size]
    [size=45]The statement stressed that “the House of Representatives must continue to perform its duties during the legislative term, and its sessions must be held under the chairmanship of one of the two Vice-Presidents until a new speaker is elected, and that the failure to elect a new speaker should not be a justification for disrupting the work of the House of Representatives,” noting that “the decision was issued by agreement based on the provisions of Articles ( 93 and 94) of the Constitution of the Republic of Iraq of 2005 and Article (5/second) of Federal Supreme Court Law No. (30) of 2005 amended by Law No. (25) of 2021 are final and binding on all authorities.”[/size]
